February 1, 1984 <br /> An Act creating the Mashpee Community Center <br /> Authority and providing for the construction, <br /> and reconstruction, maintenance and operation of <br /> a community center in the Town of Mashpee by <br /> said authority. <br /> Section 1 . There is hereby created a public body politic <br /> and corporate to be known as the Mashpee Community Center Authority, <br /> hereinafter called the Authority, which is hereby constituted a <br /> public instrumentality; and the exercise by the Authority of the <br /> powers conferred by this act shall be deemed and held to be the <br /> performance of essential governmental functions and the Authority <br /> ` shall not be held liable for any injury, loss or damage suffered <br /> by any person or property by reason of any ordinary or gross <br /> ' negligence of the Authority or any of its officers, employees or <br /> agents. <br /> The Authority shall consist of the chairman of the Board of <br /> Selectmen of the town of Mashpee, ex officio, and four other members <br /> whom shall be elected by the town of Mashpee; provided, that of the <br /> members originally elected at an annual town meeting, the one <br /> receiving the highest number of votes shall serve for three years, <br /> the one receiving the next highest number of votes, for two years, <br /> the two others , for one year. Membership in the Authority -shall <br /> be restricted to residents of the town of Mashpee . Thereafter, as <br /> a term of a member of the Authority expires , his successor shall <br /> be elected, in the same manner and by the same body, for the term <br /> of three years. Vacancies, other than by reason of expiration of <br /> terms , shall be filled for the balance of the unexpired term, in the <br /> same manner and by the same body, except elected members whose term <br /> shall be filled in accordance with the provisions of section eleven <br /> of chapter forty-one of the General Laws, as amended. Every member, <br /> unless sooner 'removed, shall serve until the qualifications of his <br /> successor. A member who ceases to be a resident of the town of <br /> Mashpee shall be removed upon the date of his change of residence <br /> by operation of law. Within thirty days of the election of the <br /> members of the Authority the members shall meet in a public place <br /> for the purpose of electing a chairman and a vice-chairman and a <br /> secretary-treasurer who need not be a member of the Authority. <br /> Three members of the Authority shall constitute a quorum; and a <br /> vote of three members shall be necessary for any action taken by <br /> the Authority. No vacancy in the membership of the Authority <br /> shall impair the right of a quorum to exercise all the rights and <br /> perform all the duties of the Authority . <br /> The chairman of the Board of Selectmen of the town of Mashpee <br /> may, whenever from time to time he shall deem it expedient , designate, <br /> by a writing filed in the office of the state secretary and the town <br /> clerk, a person for whose acts he shall be responsible, to act in <br /> his stead as a member of the Authority; and so long as such designation <br /> shall remain unrevoked, such designee shall exercise the powers and <br /> perform the duties of such Selectmen as a member of the Authority; <br /> but such designee shall not otherwise be deemed to be, or act as, a <br /> member of the Authority. <br />
