The Moderator read Article 27 <br /> Article 27. <br /> To see if the town will vote to amend the By-Laws by deleting <br /> Section 4. 7. 6 in its entirety and to replace same with the following: <br /> Section 4. 7.6 Enforcement and Penalties a. unless otherwise speci- <br /> fied, the provisions of Article 4.7 may be enforced on fresh water <br /> ponds, rivers or tidal waters of the Town of Mashpee' by police officers, <br /> the harbormaster or assistants, or a natural resource officer. b. Any <br /> person who violates any provisions of Article 4. 7 shall be subject to <br /> a fine of fifty ($50: 00) dollars for the first offense and one hundred <br /> ($100. 00) dollars for a second or subsequent offense on each succes- <br /> sive occurrence. c. The provisions of Chapter 40, Section 21D of <br /> Massachusetts General Laws providing for non-criminal disposition of <br /> by-iaw violations shall be applicable and the person taking cognizance <br /> of any violation shall have available the procedure of said Section <br /> 21D as an alternative to initiating criminal proceedings, or take <br /> any action relating thereto. <br /> Mr Lund: I move this Article as printed excepting the phrase"bs take any <br /> action relating thereto" <br /> Motion seconded <br /> Mr Shaughnessy: What you people tonite are doing is chipping away at <br /> those very freedoms. I hate jet skis; but I voted against that Article <br /> because it is ill prepared; it would mean a jet ski could not go thru a <br /> narrow passageway,no matter how well it is being operated; and you voted <br /> for that. And now you would put a penalty that is far greater than any <br /> of the crimes that would be committed. Compare the penalty you are im- <br /> posing on someone who uses a jet-ski or water skis after six o'clock <br /> at night with the felonies, housebreaks and that sort of crime. I think <br /> you better take a good look at this. <br /> Mr Schuman: We live on Mashpee bake and have for many years. This past <br /> summer some of the skiers came close enough tb kill a child. . .this is not <br /> the first time. Perhaps the 450.00 fine they might change their ways. I <br /> think this should be approved. <br /> All in favor ' say aye; opposed no <br /> Article 27 has been accepted as read. <br />
