<br /> purpose, including expenses incidental and related thereto, and to raise such appropriation, the Treasurer,with
<br /> the approval of the Selectmen, be authorized to borrow$340,000 or any other sum under and pursuant to
<br /> Chapter 44, Sections 7 and 8C and, if applicable, Chapter 40, section 8C of the General laws, or any other
<br /> enabling authority, and to issue bonds or notes of the Town therefore; and further, to see if the Town will vote
<br /> to raise and appropriate or transfer from available funds $400 to the Issuance of Debt Account; and further, to
<br /> see if the Town will authorize the Board of Selectmen and/or Conservation Commission to apply for and accept
<br /> Federal, State and/or County grants, including reimbursement under Chapter 132A, Section 11 of the General
<br /> Laws,the "Self-Help Act", to be applied by the Town toward the financing of this purchase, and to enter into
<br /> contracts or agreements with Federal, State and/or County agencies,private conservation trusts or other entities
<br /> or persons in connection with the purchase of such land and its preservation for conservation purposes; and
<br /> finally,to see if the Town will authorize the Conservation Commission and the Board of Selectmen to enter into
<br /> agreements and execute any and all instruments as may be necessary on behalf of the Town to effectuate said
<br /> acquisition; or take any other action related thereto.

<br /> Explanation: This article would authorize the Board of Selectmen to acquire, on behalf of the Conservation
<br /> Commission, all or a portion of a parcel of land on Back Road which is bounded on two sides by the Town's
<br /> existing John's Pond Park Conservation Area and fronts on both Moody Pond, the town's only large totally
<br /> undeveloped pond, and John's Pond. Purchase would complete protection of the entire shoreline of Moody
<br /> Pond. The property is within the boundaries of the Mashpee National Wildlife Refuge. The Town will apply
<br /> for a 52%grant reimbursement under the state's Self-Help Land Acquisition program to help defray the cost of
<br /> this property.

<br /> Motion: I move the Selectmen are hereby authorized to acquire by purchase, by eminent domain or otherwise,
<br /> for conservation purposes, all or a portion of a certain parcel of land,being that land shown as Lots 1 through
<br /> 11,"Open Space I", "Parcel B", "Drainage Parcel B", "Drainage Parcel C" and a portion of Back Road on a
<br /> "Subdivision Plan of Land Prepared for MacDonald Land Trust in Mashpee, Mass."By Holmes and McGrath,
<br /> Inc., dated July 12, 1989, also being shown on the 1996 Mashpee Assessors' Maps as Map 42,Block 24,
<br /> containing 20.5 acres, more or less, located between John's Pond,Back Road and Moody Pond,to be held in
<br /> the care and custody of the Conservation Commission pursuant to Chapter 40, Section 8C of the Massachusetts
<br /> General Laws, that the sum of$340,000 is hereby appropriated,to be expended at the direction of the Board of
<br /> Selectmen, to acquire the aforesaid property and to pay all other costs incidental and related thereto, and that to
<br /> meet this appropriation, the Treasurer, with the approval of the Selectmen, is hereby authorized to borrow said
<br /> sum under and pursuant to Chapter 44, Section 7 (3) of the Massachusetts General Laws, or any other enabling
<br /> authority, and to issue bonds or notes of the Town therefor, that the sum of$400 is hereby raised by taxation
<br /> and applied to the Issuance of Debt Account in connection with the issuance of bonds or notes hereunder; that
<br /> the Board of Selectmen and the Conservation Commission are each authorized and directed to apply for and
<br /> accept any and all Federal State or County grants that may be available for the acquisition of the aforesaid
<br /> Property and that the Board of Selectmen and the Conservation Commission are each hereby authorized to enter
<br /> into agreements and execute any and all instruments as may be necessary or convenient in connection with he
<br /> aforesaid land acquisition.
