3) The following conditions shall be permanent conditions <br /> of this special permit: <br /> A) The units may be constructed in three phases providing <br /> that no more than forty-one units shall be constructed <br /> in any one calendar year. i <br /> B) All units contemplated by this special permit shall be <br /> constructed within six years from the date of this decision <br /> is filed with the Town Clerk of Mashpee. <br /> C) The developer must maintain the roads, sidewalks, utilities <br /> and provide snow removal and garbage removal until the <br /> Condominium Unit Owners' Association shall maintain roads, <br /> sidewalks, utilities and provide snow removal. <br /> C-1) All roads, and utilities shall be constructed in a <br /> manner equalling or surpassing the standards set by <br /> the Town of Mashpee. (The same standards that the <br /> Town would require as if it were to accept the roadway). <br /> C-2) All utilities shall be underground. <br /> D) Parking shall be permitted on designated parking spaces only. <br /> E) All waste facilities for removal of trash and waste including <br /> dumpsters, shall be sited or fenced so as to be hidden from <br /> the public view. <br /> F) A buffer strip of at least forty feet wide shall be created <br /> along the entire perimeter of the tract as required by <br /> Section 9.352 of the Zoning By-laws. <br /> G) The westerly portion as shown upon the plan abutting <br /> Quinaquissett Avenue designated as Lot E on the plan shall be <br /> preserved in perpetuity as open space and no structures <br /> shall be built thereon. <br /> -3- <br /> { <br />
