MINUTES August 10, 1988 Page 2. <br />• JACK SULLIVAN - Requests a Variance under Section 7.4 (3) of the Land <br />Space Requirements for permission to vary the front setback in an R-3 <br />zoning district on property located at 54 Forestdale Road (Route 130) <br />(Map 27, Lot 73) Mashpee, MA. <br />Members sitting: R. Halpern, E. Govoni, C. Hawver <br />Robert Raymond of Arrow Engineering presented the Petition. The <br />Board was informed that the applicant had commenced construction of <br />a foundation on the lot when it was discovered that the lot was bordered <br />by a paper road which did not appear on the assessors' maps. Mr. Sullivan <br />explained that he would require a variance of 15.9 feet from the paper <br />road and a 39.5 foot setback from Forestdale Road. <br />Mr. Edwin Rosenthal, an abutter, objected to the Petition. He <br />explained that the rear of the Sullivan lot contained a retaining wall <br />on the boundary with reserved land to the rear. He was concerned that <br />any building activity on the land would disturb the retaining wall and <br />cause fall-off of land into the reserved area. <br />Mr. Halpern stated that he would like to review the plans with <br />Town Counsel and obtain additional information on the paper road. <br />Mr. Halpern moved to continue to September 14, 1988. Mrs. Hawver <br />seconded. All agreed. <br />• THOMAS STARAUCH AND ROBERT MILLS - Request a Variance under Section <br />7.1 and 7.5 of the Land Space Requirements for the extension of a non- <br />conforming use on property located at Lot 40B Cotuit Road (Map 29, Lot 40) <br />Mashpee, MA. <br />Members sitting: R. Halpern, C. Hawver, E. Govoni <br />The Board was informed that the owners had purchased one lot on <br />Cotuit Road containing two houses. They have received Planning Board <br />approval to divide the land into two lots. The house on Lot A is a <br />rental property in good repair. The house on Lot B is in poor condition <br />and the owners would like to have it demolished and rebuild on the lot. <br />The owners want to insure that the lot retains its buildability if the <br />house is torn down. <br />Randolph Peters, an abutter, said the house to be removed is an <br />eyesore and he would like it demolished. Douglas Boyd confirmed that <br />the house is in disrepair. <br />Mrs. Hawver moved to grant permission to have the house on Lot B <br />removed and protect the lot as a non -conforming lot for two years. In <br />addition, the owners would be allowed the option to apply for an extension <br />of the Variance if the new construction is not started within two years. <br />Mr. Govoni seconded.
