The Final Site Development Plan(s) shall be <br /> approved by the Planning Board if in gen- <br /> eral conformity to the Master Site Develop- <br /> ment Plan, patterns and uses as theretofore <br /> approved by the Board of Appeals and if in <br /> conformity to the applicable rules and regu- <br /> lations of the Planning Board. <br /> C. Each Final Site Development Plan shall show <br /> by metes and bounds the entire perimeter of j <br /> the section of the PRC then proposed to be <br /> developed, and all buildings to be erected in <br /> said section of the PRC, together with the <br /> types of buildings to be erected therein with <br /> an identification key. <br /> 9.586 Where.the developer proposes to develop a PRC <br /> Pursuant to a subdivision as to which approval iI <br /> of the Planning Board is required under the Sub- <br /> division Control Law, the developer shall com- <br /> ply with Section 9.38 of this By-Law in lieu of <br /> Section 9.585. <br /> 9.587 Approval of the Board of Appeals for use of land <br /> as a Planned Retirement Community under this <br /> Section 9.5 shall become void if the developer <br /> has not applied for a building permit with re- <br /> spect to a section of the land shown on the <br /> Master Site Development Plan within three (3) <br /> years from the date of such approval. Construe- <br /> tion of the first section shall commence within <br /> one (1) year after all local, state and federal <br /> governmental permits and approvals with re- <br /> spect to the PRC have been obtained; provided, <br /> that there shall be excluded in computing said <br /> one (1) year period any period during which the <br /> granting of any such permit or approval is being <br /> appealed or otherwise contested. In the event <br /> construction of the PRC has not been substan- <br /> tially completed ten (10) years from the date <br /> that all such permits and approvals have been <br /> obtained, computed as set forth above, then the <br /> developer shall reapply for approval for the re- <br /> maining undeveloped area under this Section <br /> 9.5. <br /> 41 <br />
