6 <br /> Board of Selectmen <br /> Minutes <br /> January 22, 2001 <br /> Public Hearing—New Seabury Properties LLC—Aboveground Storage <br /> Tanks: (continued) <br /> Motion made by Selectman Cahalane to approve the application of <br /> New Seabury Properties,LLC for the relocation of Aboveground <br /> Storage Tanks (one 5,000 gallon unleaded gas tank and one 1,000 <br /> gallon diesel fuel tank) from property identified as Map 127,Block 1 <br /> (Golf Course Maintenance Facility) to Map 98,Block 2 (New Golf <br /> Course Maintenance Facility). <br /> Motion seconded by Selectman Taylor. <br /> VOTE: Unanimous. 4-0. <br /> Selectman Marsters absent. <br /> Public Hearing—Gone Tomatoes Continued: <br /> Selectman Leveille stepped down for the above referenced Hearing. <br /> Selectman Cahalane presided and opened the Public Hearing on the All <br /> Alcohol Restaurant License of Mashpee Restaurant, Inc., d/b/a Gone <br /> Tomatoes, Mashpee Commons, Mashpee. <br /> It was noted that Gone Tomatoes has failed the fire inspection on two <br /> occasions and has also failed the building inspection. The applicant has <br /> now vacated the subject premise. There are no grounds to correct the <br /> violations since the business does not exist at the Mashpee Commons site <br /> location. <br /> William Petralia, Manager, indicated that he is presently seeking a new <br /> location for his restaurant establishment. He requested the Selectmen <br /> grant a public hearing in sixty days to hear the final results of the <br /> application. The location of the new building was not disclosed. <br /> The Assistant Town Administrator recommended the Board remit a letter <br /> to Mr. Petralia recognizing the existing violation, and go on record to state <br /> that further violations pertaining to Gone Tomatoes would be of a second <br /> offense. And further,the structured time frame of the application should <br /> not exceed six months. <br /> The hearing was opened to solicit comment. David Lawler representing <br /> Mashpee Commons indicated that the corporation, which owns the <br /> license, is in bankruptcy. He asked if the license owner would be the <br /> property of the trustee in bankruptcy, the owner or the Town of Mashpee? <br />
