5 <br /> <br />Board of Selectmen <br />Minutes <br />January 9, 2017 <br /> <br />OLD BUSINESS <br /> <br />Quitclaim Deed – Littleford Property (Hayway across Quashnet Bog Road, to the intersection of <br />Hayway and Asher’s Path): <br /> <br />The Quitclaim Deed relative to the acquisition of the Littleford property located at 104 William <br />Mingo Road and 60 Saddleback Road acquired by the Town for open space and passive <br />recreation purposes pursuant to Article 9 of the May 2016 Special Town Meeting and Article 8 <br />of the October 2016 Annual Town Meeting was presented to the Board of Selectmen for <br />execution. <br /> <br />Motion made by Selectman Cahalane to approve and execute the Quitclaim Deed relative <br />to the acquisition of the Littleford Property as presented. <br />Motion seconded by Selectman Sherman. <br />VOTE: Unanimous. 5-0. <br /> <br />Roll Call Vote: <br />Selectman Gottlieb, yes Selectman Cahalane, yes Selectman O’Hara, yes <br />Selectman Cotton, yes Selectman Sherman, yes Opposed, none <br /> <br />Memorandum of Understanding (MOU) with Mashpee Wampanoag Tribal Council – renewal: <br /> <br />The Board of Selectmen reviewed the Memorandum of Understanding (MOU) between the <br />Town of Mashpee and the Mashpee Wampanoag Tribe for the provision of fire protection, <br />emergency medical services and law enforcement mutual aid assistance. Under the terms of the <br />Agreement, the Parties would agree to extend the duration of the MOU for a one-year period <br />terminating on January 11, 2018. <br /> <br />There was concern with respect to executing the document as there has been no response or <br />communication regarding the status of the Tribal properties taken into Trust. Two letters have <br />been transmitted to the Tribe one of which was to the Tribe and to the Department of the Interior <br />Bureau of Indian Affairs in August of 2016. With regards to protocol on maintaining open lines <br />of communication with respect to the Intergovernmental Agreement (IGA), a letter was send via <br />Chairman (Board of Selectmen) to Chairman (Tribal Council) in June of 2016 and there has been <br />no response to initiate the start of reviewing matters of mutual interest. <br /> <br />In July, the U.S. District Court ruled the federal government lacked the authority to acquire land <br />in trust for the Tribe. With the understanding the court vacated the land in trust determination <br />the matter is under appeal by the Mashpee Tribe. There has been no decision to date. <br /> <br /> <br />
