6 <br /> <br />Board of Selectmen <br />Minutes <br />January 9, 2017 <br /> <br />Memorandum of Understanding (MOU) with Mashpee Wampanoag Tribal Council – renewal: <br />(continued) <br /> <br />It was noted the MOU was initiated by the Town Manager to move forward. The document has <br />been reviewed by Town Counsel in consultation with counsel representing the Tribe. Town <br />Manager Rodney C. Collins indicated if the Tribal lands are in trust or not, the Town of Mashpee <br />would follow protocol, and would not fail to proceed in a situation requiring emergency services. <br /> <br />It was agreed the Board would obtain a clear legal opinion from Town Counsel with respect to <br />the status of the land in trust. <br /> <br />Motion made by Selectman O’Hara to table this discussion until clarification is received <br />from Town Counsel. <br />Motion seconded by Selectman Cotton. <br />VOTE: Unanimous. 5-0. <br /> <br />Roll Call Vote: <br />Selectman Gottlieb, yes Selectman Cahalane, yes Selectman O’Hara, yes <br />Selectman Cotton, yes Selectman Sherman, yes Opposed, none <br /> <br />Discussion boat ramp attendants – Town Manager Follow-up: <br /> <br />As a result of budgetary constraints there was no discussion regarding the employment of <br />seasonal staffing at the Town boat ramps. <br /> <br />Appointment of Selectman John Cotton to Joint Base Cape Cod Community Advisory Council – <br />Chapter 47, Section 6(a) of the Acts of 2002: <br /> <br />With the resignation of Selectmen O’Hara from the Joint Base Cape Cod Advisory Council, a <br />vacancy was created at the last meeting. In accordance with the Acts of 2002 relative to the <br />Environmental Protection of the Massachusetts Military Reservation under Chapter 47, §6(a) <br />appointment is comprised of (1) representative from the four member Upper Cape Towns, the <br />Board of Selectmen took the following action; <br /> <br />Motion made by Selectman Cahalane to appoint Selectman John Cotton as Mashpee’s <br />representative to the Joint Base Cape Cod (JBCC) Community Advisory Council (CAC). <br />Motion seconded by Selectman O’Hara. <br />VOTE: Unanimous. 5-0. <br /> <br />Roll Call Vote: <br />Selectman Gottlieb, yes Selectman Cahalane, yes Selectman O’Hara, yes <br />Selectman Cotton, yes Selectman Sherman, yes Opposed, none
