To see if the Town will vote to add to Chapter II, Article V, <br />Section 1 of the By -Laws -- "The layout and acceptance of any private way shall <br />be in accordance with the provisions of Chapters 80 and 82 of the General Laws <br />of the Commonwealth of Massachusetts, but the Selectmen shall not recommend <br />acceptance of a road layout by the Town Meeting unless the owners of a majority <br />of the properties abutting the way have agreed to accept the estimate of costs <br />to be apportioned to each abutter, or unless the Selectmen shall determine by <br />a 2/3 vote of their .Board that a compelling public need exists for acceptance of <br />a particular way. No betterments shall be assessed until after acceptance of a <br />road layout by the Tom, nor for any way accepted by the Town prior to approval <br />' of this article." <br />ACTION: Moved and seconded to indefinitely postpone Article 16. Vote carried. <br />ARTICLE 17. To see if the Town will vote to edd to the By -Laws the following: <br />Chapter II, Article II, Section -3 -- "All fees received by all Town Officers <br />by virtue of their office shall be paid over to the Town Treasury in their entirety, <br />except that the Town Clerk shall be entitled to receive the fees provided by <br />statute." <br />Submitted by the Board of Selectmen. <br />Recommended by Finance Committee. <br />ACTION: Moved and seconded to accept Article 17 as read. Vote carried. <br />ARTICLE 18. To see if the Town will vote to change Section 2 of Chapter III, <br />Article V of the Town By -Laws: <br />"It shall be unlawful for any person who has not attained the age of twenty- <br />one years to consume or have in his or her possession alcoholic beverages on public <br />highways, including vehicles thereon, or public places within the Town of Mashpee. <br />Whoever violates the provision of this by-law shall be fined in an amount not <br />exceeding fifty dollars for each offense" by deleting "Twenty-one" and by inserting <br />"eighteen" in place thereof.. <br />Submitted by the Board of Selectmen. <br />ACTION: Moved and seconded to accept Article 18 as read. Vote carried. <br />ARTICLE 19. To see if the Town will vote to amend Chapter III, Article II, <br />Section 3 of the Town By -Laws by adding the words "or tent" after the word "trailer" <br />in the sentence beginning "No person shall park, store, or occupy ........." <br />and by adding to paragraph numbered (2) the words "or tent" after the words <br />"non-paying guests using a trailer". <br />Submitted by the Police Department. <br />ACTION: Moved and seconded to accept Article 19 as read. Vote c&tried. <br />ARTICLE 20. To see if the Town will vote to rescind Chapter III, Article VII, <br />Section lA of the Mashpee Town By -Laws: "The use of boats with engines in excess <br />of forty-five horsepower on John's Pond and Ashumet Pond shall be prohibited. Any <br />violation of this by-law shall be punished by a fine of up to $50.00.11: in place <br />of this rescinded article we propose the firm enforcement of all safety regulations <br />and Town By -Laws as they relate to the lakes and ponds of Mashpee. <br />Submitted by Mashpee Citizens. <br />ACTION: Moved and seconded to indefinitely postpone Article 20. Vote carried. <br />' ARTICLE 21. To see if the Town will vote to add to Chapter III, Article VI <br />of the Town By -Laws the following: <br />Section 2 -- "Hotels, boarding or lodging houses, or family hotels which are <br />not regulated by sections twenty-six A and twenty-six B of Chapter 148 of the <br />General Laws shall be equipped with an automatic smoke or heat detector in each <br />dwelling unit and each hallway floor. The head of the fire department as defined <br />in section one of Chapter 148 shall enforce the provisions of this section. <br />The Town hereby accepts the provisions of Chapter 149, Section 26C of the General <br />Laws." <br />Submitted by the Board of Selectmen. <br />ACTION: Moved and seconded that Article 21 be accepted as read. Vote carried. <br />
