-13- <br /> Letter- "Please be advised that the DEQE has received an appeal to the Order of Conditions <br /> Issued on file #43-116 and that according to the general laws, Chapter 131, Section 40, the <br /> DEQE will make a determination on whether the area in which the proposed work to be done is <br /> significant to public or private water supply, the ground water supply, flood control, <br /> storm damage prevention, to prevent erosion of land containing shellfish or to the protec- <br /> tion of fisheries. After making such determination, the DEQE will issue a superseding order <br /> posing such conditions as will contribute.to. .the protection of the interests described herein. <br /> No work as proposed in the Notice of Intent for the above reference file shall be undertaken <br /> until the final order is issued by the DEQE. All appeal periods have elapsed." <br /> Pauline: Mr. Hollander appealed our Order of Conditions. <br /> Charles: Then it is out of our hands and in DEQE's. <br /> Mr, Hollander: What was the hurry? Mr. Hill and I both wrote a letter objecting to that <br /> building and stating that we were going to come in. I know you people don't act that quick <br /> on any other. <br /> Dorothy: We are required by statute to hold a hearing within twenty-one days and to issue <br /> an Order of Conditions within twenty-one days after the hearing. <br /> Mr. Hollander: Are the abutters supposed to get a notice before that time? We got a notice <br /> a couple of days before. It was mailed March 11 and I received it the 14th of March and <br /> you held the hearing the 26th of March. I thought that was pretty fast work. <br /> Wayne: What is the law about notifying the abutters? <br />`Pauline: The abutters are notified by the party, and we have dated receipts that Mr. Bunikis <br /> gave us that he had sent to Mr. Hollander and Mr. Hill. <br /> Wayn e: Is there anything else sent out to the abutters? <br /> Pauline: The public hearing notice and the builder notifies them. <br /> Mr. Hollanders We didn't receive any plans or anything else. We wrote for that. <br /> Pauline: I am sorry. I told you upstairs that Mr. Bunikis told you that he was going to <br /> send you plans. The Conservation Commission did not say that they were going to send you <br /> plans. We have the plans on file here for you to view. <br /> Mr. Hollander: I think that where the pool was was as good a place as anything. <br /> Pauline: It was 10 feet closer to the top of the bank. <br /> Mr. Hollander: The excuse you gave before was that it was the foundation of the house. The <br /> .house foundation is 12 feet back of that whole woods area. <br /> Pauline: There was a tree there. <br /> Mr. Hollander: One tree! You're conservations, right? You are willing to take out twelve <br /> trees to save one. <br /> Pauline: Those are pine trees. <br /> Mr. Hollander: No, they are not. They are all oaks, <br />
