-5-
Charles: That is an entirely different area.
Barbara: Oh indeed he doesn't get as much tidal action as Larry does.
Pauline: No, that is a still area in there.
Charles: All he is worried about is the rise and the fall of the water.
Pauline: The height of the water is all he is worried about. There is no tidal action
in there.
Wayne: And the footing of it is right in the water?
Pauline: Yes. I don't know what is on the bottom of that.
Barbara: I don't remember.
Mr. Hecht: I am just wondering if it is the same action that drives mine forward would
drive that forward if it is vertically placed.
Wayne: Then you can anchor it back. That is where the deadmen come in.
Mr. Hecht: The deadmen will help to stop that if it is done properly.
At this point the Board reviews the plan on the duck pond retaining wall. The Mashpee
Conservation recommended the installation of a wooden bulkhead having the following speci-
fications: 8" piles, 6 foot okay, 9 foot penetration, 4" sheathing 10 foot long, 4 x 10
deadmen steel enforcement product and similar to that of adjoining property.
Charles: He has a combination of the piles, the deadmen and the horizontal . .. I think
it is cheaper and easier to go the other way.
Pauline: We will take this under advisement.
Charles: I would talk to Rebello about that vertical.
Orders of Conditions
12. As shown on the plan with the addition of vertical piles.
13. Piles must be driven 9 feet below mean high water.
14. These vertical piles to be attached physically to horizontal timbering.
Jean Pierre Sanchez -- Owner of Record: Douglas & Carolyn Stevens
Agent: Mr. Tim Hennigan
Lots 271 and 43 Way Rd. , Daniels Island Rd. , Mashpee
Pauline: Read Notice of Intent -- to build two residences using "in Kind" fill to flood
plain elevations and to comply with existing General Laws, in accordance with plans on
file with the Mashpee Conservation Commission.
Mr. Hennigan: At our last session by vote this Commission agreed to issue an Order of
Conditions on both lots providing the legality of the measure was assured. Subsequent to
that meeting in discussion with town council, we agreed because there was some reasonable
doubt that you could not issue an Order of Conditions after a denial, we were asked to re-
submit. We have now re-submitted. I respectfully request this Commission to re-affirm
this commitment to the Applicant.
