-2-
Chet Koblinsky: Regarding the Cushner dock, town counsel has been brought in to see
if we can override the State. Pauline, you have asked town counsel to write up an
article for the September meeting for a 45 foot limitation on docks?
Pauline: I have requested in the letter that I wrote to him when I gave him the
Cushner file.
Jeannie: We are going to have a special town meeting in September so I think that we
ought to jog his memory.
Pauline: Requests secretary to write a letter to town counsel asking him to write a
legally worded article for the special town meeting to limit docks to 45 feet in mean
low water. (Letter sent 8/1/80)
Chet: I talked with Atty. Pope, he said you people should have known that when we okayed
it, it was for his request of 160 feet. I said we assumed it was okayed for the town for
125 feet. I told him we were contesting it and he wanted a couple of days to check into
it. He said he would call me back and if he doesn't, I will call him on Friday. Then,
I talked with Mr. Law. I brought up the two facts -- one is that our native population
cannot walk along the shore with that dock (we want that written in the deed) and the
other point we want is that we want lights on these docks. There is a Coast Guard re-
quirement that any dock over 100 feet has got to be lit unless there is an exception and
there is no exception on this. The other thing I brought up with Mr. Law is that on that
plan there is a record of moving a mooring. I said that is not a mooring. That is a
navagational aid and Law says he thinks so too. I said that channel shifts from year to
year. It might go in 15 feet or out. He wrote that down.
Jeannie: What do you feel is 'a good length that is sensible?
Chet: I think the town by-law should be written up a maximum of 45 feet unless the
majority of the selectmen approve it. In other words, you always have to leave yourself
a little bit of an out.
Pauline: Sometimes you will not draw that much water in that 45 feet.
Chet: The water in Mashpee everywhere is shallow. In some places, you have to go out
600 feet to hit deep enough water. If people want deep water and have a big boat, they
should buy a lot with deep water.
Andrew S. Kariotis, Lot X110, Tide Run, Mashpee
Agent: Eldredge Engineering, Hyannis -- Mr. Bunikis
Atty: Mr. James Smith
Pauline: Reads the public notice -- to construct a docking facility -- Scheme A, 108 ft. ,
Scheme B, 120 ft, in length from Lot 10 Jehu Pond into Jehu Pond in accordance with plans
on file with the conservation commission. Asks Mr. Bunikis to present what he plans to d
Mr. Bunikis: We are asking for this pier, float. I have presented two different schemes
for consideration for the Board. There are existing steps and that is the idea that we
go down the steps onto the pier and, of course to the float and to the boat. The other
