-5-
SE43-137
William & Lola Hardy, Randolph, 14a.
Pauline: Notice of Intent is read -- to construct a single family house on Pond Circle,
JohnsPond, Mashpee, in accordance with plans on file with the Mashpee Conservation Com-
mission. Now, would you present to the Board what you plan to do, sir?
David Hardy: Shows on the plan where the dwelling is located. We tried to get as far
away from the pond as we could but this corner does get within 100 feet.
Pauline: Yes, I was down there.
David Hardy: This is not really at Johns Pond -- it is an area that is dug out.
Pauline: Johns Pond, West. We know. We have been here since World War II.
Dorothy: You needn't go into it any further.
Pauline: I was down and you have it all dug out already.
Bill Hardy: Yes.
Pauline: Did they stop you from digging? Is that why you filed?
David Hardy: No, we made plans with LaBute awhile back and he decided that he needed a
lot of fill he took out. So, he did it. I did talk to Hal Collins and he said if you
- want to dig a hole it is all-right but don 't go any further.
Pauline: I see no problems with it at all. So, we will issue an Order of Conditions
and you are to post your DEQE number, SE43-137, on a Board.
David Hardy: We didn't receive anything from DEQE, yet.
Pauline: We did and your number is SE43-137. You should have received a copy like this
shows the one Conservation Board received).
Wayne; If you plan any decks or you have any plans for any landings, dock, piers or any-
thing, you have to file with the Conservation Commission.
David Hardy: In the future, there will be a deck over here (shows the spot), but it will
be more than 100 feet.
Pauline: So, you post that number on a board on a minimum of 2 x 2 feet. You will re-
ceive an Order of Conditions and when you receive that, on the bottom of page 2, there is
a piece of paper that you cut off and you file it at the Registry of Deeds in -Barnstable.
That will become a legal document that will go with your deed.
David Hardy: Is there a charge for that?
Pauline: You pay for that at the Registry of Deeds in Barnstable. You don't start any
building until ten days after you receive your Order of Conditions. That is the appeal
period.
David Hardy: How long will that be before we receive our Order of Conditions.
Pauline: As soon as we get the Order of Conditions drawn up, they will be mailed out to
you, registered mail.
