Mr. Haywood was unable to begin construction on the property because of <br /> a. variance that was required by the owner of the adjacent lot. Because of the ab- <br /> sence of the variance, Mr. Haywood was unable to record the deed and the DF;�E per- <br /> mit until February, 1980. The revolution of the Indian law suit further affected <br /> his ability to begin construction.
