MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 8, 2017 <br /> Mr. Frank Westgate represented the homeowner's application for a Variance request for <br /> the reconstruction of their driveway that is within the 50 ft. buffer setback from the <br /> wetlands. He said the driveway slopes down from the road at a 28 foot length and is 12 to <br /> 14 feet wide, and slopes under the basement which is the existing garage. There are two <br /> concrete retaining walls and the fill will not go above those walls. There will be no need <br /> for a curb cut, and it will have no drainage issues. There will be a slight pitch toward Little <br /> Neck Lane with gravel fill and a pea stone finish that will control the drainage. <br /> Mr. Bonvie read the Conservation Department and Inspection Department comments into <br /> the record. <br /> Mr. Blaisdell read the Board of Health comments into the record. There are no issues. <br /> There were no more comments from the Board or audience. <br /> Mr. Bonvie made a motion to issue a Variance based on a Plot Plan--Proposed Driveway <br /> Reconstruction, 18 Little Neck Lane, Mashpee, MA, Pd. LD., 105-6-0, L.C. Cert 183848, <br /> Owner/Applicant: Stuart & Christine Nixdorff, Scale: F'= 16', June 8, 2017, from the <br /> office of Westgate Survey & Engineering Associates, 60 Summer St., Kingston, MA <br /> 02364, Signed by: Robert A. Junior, No. 18921 Registered Land Surveyor. Revised <br /> 09/19/2017 to depict septic system. The Board issues this Variance in regard to the setback <br /> from the wetlands under Section 174-33,as depicted on the submitted plot plan which does <br /> not indicate any specific dimensional information. <br /> Mr. Blaisdell seconded, yes, Mr. DeBarros, yes, Ms. Sangeleer, yes, and Mr. Furbush yes. <br /> All were in favor of the Variance reconstruction to the existing driveway. <br /> 29 Overlook Knoll Road: Owners, Frederick J. and Linda Naddaff request a Written <br /> Finding under §174-17 of the Zoning Bylaws to raze and replace a single-family dwelling <br /> and deck on property located in an R-3 Zoning District and the Popponesset Overlay <br /> District, (Map 118 Parcel 33), Mashpee, MA. <br /> There was no representation present for this hearing. <br /> Chairman Furbush read comments into the record from the Conservation Department <br /> stating that the project was approved however, the abutters have appealed the <br /> Commission's approval to Mass DEP. The process typically takes more than a month. Mr. <br /> Furbush said that they will be continuing this hearing because the Board reviews the <br /> applications based on Town department commcnts. <br /> Attorney Alexander Joyce represented the abutter at 25 Overlook Knoll Road,John Lynch <br /> who was also present. Attorney Joyce said he filed an appeal with Barnstable Superior <br /> Court seeking judicial review of a construction permit issued by the Board of Health. <br /> 6 <br />
