Review of Bylaws impacting the Building De artment continued <br /> 174-25.1(6 Accessory Uses (Page 37). <br /> Mike suggests for Residential R-3 and R-4 categories, rather than going to Plan Review <br /> the designation be changed to SP (Special Permit) so the project goes to either ZBA or to <br /> the Planning Board. <br /> Bylaw Review will get input from Plan Review members. Should designation be PR/SP <br /> or just SP? <br /> 174-25.1(91---Accessory es (Page 38). <br /> Why under ZBA? Suggest deleting SP (Special Permit) and just leave the Y (Yes <br /> Permitted). By deleting ZBA this waterways type accessory use would be under <br /> Conservation. Mike and Drew again explained that having ZBA requirement under this <br /> bylaw is unnecessary duplication since ZBA relies on Conservation decision. Mike <br /> provided suggested wording as replacement. Bylaw Review Committee will get ZBA <br /> input when meeting with them. <br /> 174-33—Setback from water and wetlands (Page 60). <br /> Mike and Drew propose deleting this zoning bylaw. Drew explained that this is fully <br /> covered by State laws and by a number of Mashpee General Bylaws. <br /> Bylaw Review Committee agreed since this is fully covered in the General Bylaws, it is <br /> redundant to be in the Zoning Bylaws. However, the Committee felt it would be <br /> beneficial to leave the 174-33 heading and include a cross-reference to the General <br /> Bylaw sections that cover this topic. In this way, should someone look in Zoning they <br /> will be referred to the applicable bylaws. Drew will provide the bylaw sections to be <br /> referenced. <br /> 174.17.1—Continuance; Extensions; Alterations (Page 14). <br /> Mike said everything goes to the ZBA so he is going to draft proposed wording changes <br /> for this bylaw and submit to the Committee at the next bylaw review meeting. <br /> 174-31.23—Land Space Requirements Table Footnotes (Page 59). <br /> Mike will draft language to amend this bylaw to cover swimming pools under this <br /> section. <br /> 174-45.5—Land-Based Wind Energy Conversion Facilities (Page 90. <br /> Mike will cheek on this and report back to Bylaw Review Committee. <br /> 2 <br />
