Motion. Mr. McKay moved to Close and Issue, seconded by Mr. Shaw. Vote
unanimous 4-0
6:03-Kathleen A. Impey, 90 Captains Row. Proposed replacement of existing retaining
wall within same footprint and construction of new pier, ramp and float. NOI
Resource Area: Land Under Water, Coastal Beach, Land Subject to Coastal Storm
Flowage, Coastal Bank, Coastal Beach, Land Under Ocean
Matt Costa, Cape and Island Engineering, represented the applicant. He said the applicant
previously received all their required approvals to install their dock but realized their order of
conditions expired. They filed the same exact plans. The site hasn't changed and there
are 0 changes since the last approval. It has a Chapter 91 license. There have been no
additional comments from the shellfish warden or harbormaster. The proposed project
involves the construction of a new dock consisting of a pier, ramp and float that will extend
below mean high water into Popponesset Bay. Also proposed is a concrete block wall
within the existing footprint with a fieldstone wall. The construction of the dock will include
fourteen 10-inch diameter piles, two 6" by 6" posts, support timbers, decking and railings.
The dock will consist of an elevated walkway with a 16' long ramp and a 6' by 25' float. A
mitigation plan has been submitted. Mr. Costa respectfully requested the previous order of
conditions be re-issued.
The Agent noted Rick York Shellfish Constable was OK with the design and the
Harbormaster said there were no navigational concerns. There was a discussion on the
letter from the Division of Marine Fisheries and their recommendations. Mr. Costa said
their proposal meets the performance standards. The Agent noted the letter contained
recommendations for the commissioners to review. One recommendation was to increase
the spacing of the fixed pier planks for sunlight but there is no salt marsh there. The
spacing proposed should be adequate for aquatic vegetation and meets the design
standards.
No comment from the public
Motion: Mr. McKay moved to Close and Issue, seconded by Mr. Shaw. Vote
unanimous 4-0
6:06-43 Waterline LLC, 43 Waterline South Drive. Proposed demolitionlreplacement of
single-family home along with construction of pool, patio and septic system upgrade. Plans
also call for reorientation of walkway to pier. Due to failure by the Mashpee Enterprise to
publish notice properly, rescheduled from 4/14/2016. -NOI
Resource Area: Salt Marsh, Land Subject to Coastal Storm Flowage,
Andrew Garulay, Yarmouthport Design Group and BSS Design, represented the applicant.
He explained the existing house is to be razed and replaced. The house will be moved
back from the resource area and a swimming pool and patio will be out of the flood zone.
The septic system will be replaced with a new system. Trees will be removed for the septic
system and a retaining wall Installed. There isn't much natural vegetation and they are
proposing to fill the areas around the house with native plantings. The existing licensed
pier will have to be realigned which will not have a big impact. They will also add some
native plantings along the buffer zone. He noted down the road they will be submitting
