The Agent noted there is no removal of any native vegetation for any of the <br /> improvements proposed and he recommended a Negative Determination. <br /> No comment from the public <br /> Motion: Mr. Sweet moved a Negative Determination, seconded by Mr. Smith. Vote <br /> unanimous 6-0 <br /> 6:09 Patrick M. and Sharon M. O'Connor, 66 Massasoit Avenue. Proposed <br /> addition of deck to existing dwelling. At request of applicant, continued from <br /> 10112. RDA <br /> Resource Area: Buffer Zone to Bordering Land Subject to Flooding (John's Pond) <br /> Patrick O'Connor, homeowner, explained his project is to construct an addition to the <br /> deck on the existing dwelling. The Agent explained on the,pictures the sloping hill which <br /> is interrupted by a break in slope on the other side of the road. The setback of the inland <br /> bank is outside of 50'. He noted the Board of Health comments that the property is <br /> located in zone II and to please notify the applicant that the proposed deck cannot be <br /> constructed over the septic tank. <br /> No comment from the public <br /> Motion: Mr. Smith moved a Negative Determination, seconded by Mr. Sweet. Vote <br /> unanimous 6-0 <br /> 6:12 Nicholas Dostilio (Applicant), 95 Tamberlane Drive.- Proposed Eagle Scout <br /> project to reestablish kayak landing along with landscape and hardscape <br /> improvements. Owner of record: Town of Mashpee. Due to failure of Mashpee <br /> Enterprise to publish notice, rescheduled from 10112. RDA <br /> Resource Area: Bordering Land Subject to Flooding, Buffer Zone to BVW, Land <br /> Under Waterbodies/Waterways <br /> Nicholas Dostilio explained the project is Phase I I of a 3 phase project. The project is <br /> scheduled for November 10, 11, and 12. He reiterated his comments from the October <br /> 12 meeting and explained the area will be excavated to get rid of the overgrowth and <br /> flatten the area. A berm will be made to protect the pond from runoff and a filter fabric <br /> will be placed down as well as the sand. He also explained the path on the hill will be <br /> dug out to put in the backfill and timbers will be placed for stairs. Nicholas stated he has <br /> been working with a contractor. The Agent requested Nicholas correspond with Katelyn <br /> Cadoret advising her of the dates and any changes in construction. <br /> No comments from the public <br /> Motion: Mr. Smith moved a Negative Determination, seconded by Mr. Shaw. Vote <br /> unanimous 6-0 <br /> 6:15 Peter J. Merlino, et al Trustees, 18 Quaker Run Road. Proposed Amendment <br /> to Order of Conditions 43-2478 to allow for dock modifications.
