ADDITIONAL TOPICS (This space is reserved for topics that the Chairman did not reasonably anticipate would be discussed. HEARINGS: 6:00 James E. Heppelmann & Mary R. Hable, 199 Daniels Island Road. Proposed construction of access stairs to existing dock. RDA Resource Area: Salt Marsh, LSCSF Michael Borselli, Falmouth Engineering, represented the applicant. He explained there is an existing dock that was constructed in the 90s and fully permitted. They were issued a license from DEP Wetland and Waterways and a provision of the license was that the license must be recorded within 60 days. The license was never recorded which made it null and void. He explained the project was to construct a dock and DEP is requiring stairs be installed for public access. He said they are here to get permission to install the access stairs. The Agent suggested the access stairs use flow thru decking on the steps to allow for sun penetration. No public comment Motion: Mr. Shaw moved a Negative Determination, seconded by Mr. Shaw with the condition as stated above. Vote unanimous 5-0 6:03 Robert D. & Carolyn J. Kelly, 31 Birch Way. Proposed septic system upgrade. RDA Resource Area: Buffer Zone to Top of Inland Bank, Mashpee Pond Wayne Tavares, Wet Tech Land Design, represented the applicants. He stated the owner is proposing to upgrade the existing septic system to accommodate the existing 3 bedroom dwelling. The old septic tank is to be removed and replaced with a new septic tank. No work is any closer to the resource areas. The Agent reported the Board of Health has received the application and has determined the property is in Zone 11 and the plans are under review for a conventional Title V system to service an existing three bedroom dwelling. He recommended a Negative Determination. No public comment Motion: Mr. Shaw moved a Negative Determination, seconded by Mr. Smith. Vote unanimous 5-0 2
