MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />MAY 242 2017 <br />Also conditioned upon all department comments read into the record. <br />Mr. Pittsley seconded, yes, Mr. Furbush, yes, Mr. Blaisdell yes, and Mr. DeBarros, yes. <br />All were in favor of the Variance for the proposed garage based on all the conditions read <br />into the record. <br />5 Kanter Lane: Owner, Neal Kanter requests a Written Finding under §174-17 of the <br />Zoning Bylaws to raze and replace a single-family dwelling, deck and garage on property <br />located in an R3 Zoning District, Map 119 Parcel lA-0, Mashpce, MA. <br />5 Kanter Lane: Owner, Neal Kanter requests a Variance under §174-31 of the Zoning <br />Bylaws to raze and replace a single-family dwelling, deck and garage on property located <br />in an R3 Zoning District, Map 119 Parcel 1 A-0, Mashpee, MA. <br />Mr. Neal Kanter represented himself for the proposed raze and replace project. He said his <br />family has owned the property for over 50 years, and is currently just using the property as <br />a summer cottage. It was built roughly in the 1930's, and was remodeled many times over <br />the years and is currently uninhabitable due to the septic system failure. The current house <br />was there prior to the lot being subdivide and the road being constructed. He is proposing <br />to build a new house similar to the current house with a slight increase in the foot print <br />being 2 ft. toward Kanter Lane, and 1.5 ft. setback increase on the West side, the foundation <br />setback will increase from 7 ft. to 10 ft. <br />Mr. Bob Lynch and Diane Brace of 3 Seconsett Point Road are supportive of the project. <br />Mr. Bonvie read the Inspection Department comments into the record. Chairman Furbush <br />read the Board of Health and Conservation comments into the record. <br />Mr. Bonvie made a motion to issue a Written Finding for the raze and replace project at 5 <br />Kanter Lane based on the Site Plan —Project: Sewage Disposal System Design, 5 Kanter <br />Lane, Mashpee, MA, Owner of record: Neal Kanter, 15 Ostrom Road, E. Falmouth, MA, <br />Applicant: Neal Kanter, 15 Ostrom Road, E. Falmouth, MA. All <br />were in favor of the raze and replace project at 5 Kanter Lane. <br />Mr. Bonvie made a motion to issue two Variances to Neal Kanter of 5 Kanter Lane, the <br />first variance is 27.6 feet on the front yard it is showing 12.4 ft., and the requirement is 40 <br />ft., the second Variance would be on the West side, the requirement is 15 ft. and depicted <br />as only 12 ft., and the Variance will be in the amount of 3 ft.
