MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />JULY t2,2017 <br />73 Mercantile Way: Petitioner, Richard McCracken requests a Special Permit under <br />§ 174-25 (G) (6) and § 174-25 (G) (9) of the Zoning Bylaws to allow for construction of a <br />15 unit, 9,939 square foot boat storage building, and an outside gravel surface boat storage <br />area on property located in an I-1 Zoning District, (Map 88 Parcel 94), Mashpee, MA. <br />(Owner of Record: Suzanne Rogers). <br />Attorney Kevin Kirrane represented the application for the prospective purchaser of the <br />property located at 73 Mercantile Way. Also present was Mr. McCracken, Petitioner, Matt <br />Eddy, with Baxter Nye Engineering, and Joao Junqueira, with Capewide Construction. The <br />plot plan shows that the property is located in the I-1 Industrial Zone. The lot consists of <br />159,560 sq. ft. and has 300 linear ft. along Mercantile Way and abuts Great Hay Road <br />which is an unapproved way on the south easterly section of the lot. This parcel will be <br />serviced by public water supply and there is a proposed independent onsite sub -service <br />sewage disposal system as part of the overall system of the site. This matter has gone before <br />the Mashpee Plan Review Committee, and they recommended approval with the submitted <br />plans. <br />The applicant is proposing construction of a 9,939 sq. ft. industrial storage building which <br />is typical of a number of buildings that have already been constructed in the Industrial Zone <br />areas. The building will be separated into a maximum of fifteen (15) separate units as <br />provided on the site plan. The building is also proposed to include a common restroom <br />facility, handicap accessible on the northerly end of the building, and equipped with a <br />sprinkler system -for fire safety. Each unit will have an overhead door to accommodate the <br />storage of boats or vessels which is the intended use and is allowed under the bylaw. The <br />applicant is also proposing outside storage that was highlighted in blue on the plan. There <br />will be two size units in the building, and the outside bays will be consistently sized for the <br />storage of vessels. It is a one story building with overhead doors large enough so they can <br />accommodate these vessels and vessels on a trailer. <br />The general criteria for special permit relief is set forth in section 174-24 (C). The Board. <br />must determine that relief can be granted without adversely impacting health and safety <br />concerns or creating excessive demand on community facilities, decreasing surface or <br />ground water quality or air quality adversely affecting the environment, etc. <br />The boat storage use will largely be used actively in the winter months because the owners <br />will be using their boats during the summer months. Most of the activity in the facility will <br />be during the winter months so the owners can maintain their boats. <br />Attorney Kirrane also provided drafts of the possible boat loft condominium documents <br />that were requested at the Plan Review meeting. <br />Mr. Bonvie asked if there will be one association that will be handling this whole project. <br />He asked if these condominium documents outlined any type of maintenance regarding <br />drainage areas, i.e. rain gardens, etc. Mr. Bonvie requested this verbiage to be a line item <br />in the deed. Mr. Bonvie would like to have the verbiage noted, i.e.: "a visual inspection <br />shall be made in all bays." He wants to know who will inspect it. Mr. Bonvie would like <br />the condominium documents reference to the Board's approval of a maintenance plan. <br />7 <br />
