MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />JULY 26, 2017 <br />Chairman Furbush asked if those Board of Health requirements were available. <br />Mr. Cook said the plans were drawn by JC Engineering and complies with the 20 ft. <br />setback. <br />An abutter that lives at 3 Bayview Way wanted clarification on the building plans and <br />parking. The abutter asked if it's possible to drive over the septic system. <br />Mr. Goldstein said that if the septic is under the driveway, it has to be designed to handle <br />that. The structures are not allowed to go over the 20% lot coverage, and in this case it is <br />under. <br />Mr. Blaisdell made a motion to approve the application with the conditions of the site and <br />floor plans, and the Town department comments read into the record. Mr. Gould second, <br />yes. All were in favor of the bedroom addition. <br />Mr. Cook asked why this application would require a Written Finding if the project meets <br />all the requirements. <br />Mr. Goldstein said that the Building Commissioner does not have the authority as stated in <br />the bylaw. The bylaw committee needs to review this request and is available with the <br />Clerk. <br />56 Spoondrift Way: Owner, Amy P. Coghlin requests a Written Finding under §174-17 <br />and § 174-20 of the Zoning Bylaws to raze and replace a single-family dwelling on property <br />located in an R-3 Zoning District, (Map 112 Parcel 37), Mashpee, MA. <br />Mr. Goldstein stepped down from this case. Sitting on this hearing are the four regular <br />board members and Associate Brad Pittsley. <br />Attorney Kevin Kirrane represented the applicant for this raze and replace project. He <br />provided the Board with plot plans, photographs of the left hand side of the property, of <br />the existing structure, and similar raze and replace projects in the immediate neighborhood. <br />The color plan shows highlights of the existing structure. The shaded gray area is the <br />proposed structure. The property is situated on an approximately 15,000 sq. ft. lot and has <br />approximately 100 feet of frontage on Spoondrift Way and slopes to the Popponesset Creek <br />and drops 16 ft. which will allow for a walk out basement in the design of the house. The <br />lot is wider in the front and narrows to the rear. <br />The existing structure is approximately 2800 sq. ft. and covers 19.8% of the lot. The <br />residence is a three (3) bedroom home and was built in the late 1960's. The structure is <br />non -conforming and is 6.1 ft. from the northerly side line, and the existing structure sits <br />12.6 ft. from the southerly side line. The deck that will be remaining sits 11 ft. from the <br />property line. The actual building sits 12.6 ft. from the property line. The coastal bank runs <br />through a portion of the existing deck and is only 10 ft. from the saltmarsh. The current <br />structure is 30.4 ft. off the saltmarsh. <br />3 <br />
