MASHPEE ZONING BOARD OF APPEALS <br />MARCH 23, 2016 <br />MINUTES <br />91 Edgewater Road: Owner, Joseph H. Appleman requests a Variance to extend an <br />existing deck S ft. under § 174-33 of the Zoning Bylaws to vary the setback at least fifty <br />(50') feet from any water or wetlands on property located in an R-5 Zoning District, (Map <br />23 Parcel 119), Mashpee, MA. <br />Mr. Joseph Appleman represented himself for the dock expansion project. He provided the <br />Board with a plan and a hand -drawn picture of the dock he wants to expand S ft. located <br />22 feet uphill from Santuit Pond. He received approval from the Conservation Commission <br />at their last hearing. <br />Chairman Furbush read comments from the Board of Health into the record; "septic is <br />upfront no problems here". Conservation Department; "This proposal was approved by the <br />Mashpee Conservation Commission on February 25, 2016", and the Inspection Department <br />comments; "The area is zoned R5 and is in the Pre -contact Archaeology Sensitivity area — <br />listed as "High Sensitivity". The applicant is seeking a Variance under §174-33 regarding <br />expanding existing structure (free standing deck) within the fifty foot setback from any <br />water or wetlands." <br />Mr. Paul Cononi, an abutter that resides at 101 Edgewater Road addressed the Board and <br />had concerns with the association right-of-way being blocked by building debris. He said <br />Mr. Appleman also removed trees in the past without permission from Conservation <br />Commission. He also consulted the Building Department asking if any permits were pulled <br />for the property on the existing deck. <br />Mr. Hugh Ahern, an abutter that resides at 104 Edgewater Road approached the Board and <br />had concerns with building structures blocking the association property causing obstructed <br />access to the pond. <br />Mr. Furbush stated that the Zoning Board only hears petitions for Variances, Special <br />Permits, and Written Findings; and does not hear requests for other Town committees. <br />Mr. Appleman said he was given a large list of plantings and will install them as instructed <br />by the Conservation Agent and Commission. <br />Mr. Gould stated fiom his past experience as a conservation board member he would meet <br />with the applicant at their home and decide what type of plantings would be appropriate. <br />The permit is good for three (3) years. <br />Mr. Goldstein made a motion to approve the variance for extending the deck. A Plot Plan <br />of Land Located in Mashpee, MA, Prepared for 5-D Construction, Date: Apr. 16, 1997, <br />Scale 1"— 30 ft., Cape & Island Engineering, Mashpee, MA. Footings are in place and the <br />job could be done in 2 days. This approval is also conditioned that all orders issued by the <br />Conservation Department must be in place prior to final sign off from the Building <br />Department.
