The Chair inquired whether <br />a provision should be included in the contract requiring usage of the rail. There was agreement <br />not to make it a requirement as the UCRTS experienced its own challenges with the railroad, <br />Regarding roll off and dumpster storage, Board members were in agreement that they would <br />need to be clean, but no cleaning allowed on site and empty. Mr. Barrett expressed concern <br />about a possible rat infestation with staging loaded trailers. Mr. Segura stated that the Base <br />would have concerns if there was an odor issue. Mr. Jack referenced Mr. Cavossa's proposal in <br />reference to vehicle and equipment maintenance. There was also discussion regarding timing of <br />truck traffic, as well as questions about a mechanic working at the site. Emergency repairs only <br />would be allowed, with specific machinery listed. <br />Regarding insurance requirements, the RFP listed $2 million liability and property damage and <br />$5 million aggregate limit. Returning to the topic of the tank, there was agreement to remove the <br />tank in order to remove the liability. Additionally, there was no detail offered in the proposal <br />regarding the tank. <br />The Chair inquired whether the Board wished to request funds for escrow in order to address the <br />permitting process. Mr. Richard stated that DEP would likely want the UCRTS name on the <br />permit, as well as Cavossa, as another point of contact if needed. Mr. Richard suggested <br />wording in the contract that would transfer fines to Cavossa if levied by the DEP, through an <br />account. The Chair inquired about reporting and inspections as required by DEP. It was <br />suggested that inspections occur unannounced. Escrow will be established for permitting, <br />reporting, DEP semi-annual inspections, traffic studies/engineering support and a balance of cash <br />in case of fines. <br />Returning to the topic of caps, it was determined to maintain a cap of 30,000 tons, with <br />renegotiation to occur above the amount or use of the facility by others outside of Cavossa. <br />Regarding daily truck trips, a maximum of 25 inbound truck trips would be allowed. <br />Mr. Barrett pointed out aspects of Mr. Cavossa's timeline to include his request for a radiation <br />monitor and also the operations plan, where on page 3, he referenced sorting and processing <br />waste, which was not intended for the site. The Chair inquired about the operations plan and Mr. <br />Richard confirmed that a change in operation would require a different permit. Mr. Barrett also <br />referenced the outgoing materials schedule and the possibility of it being covered until moved to <br />another facility, noting that it would likely not be allowed by DEP. Operation of the UCRTS <br />allowed for up to 48 hours of the rail cars. Mr. Richard recommended stipulating a time limit of <br />no more than 24 or 48 hours for MSW. Mr. Jack thought the statement referred to C&D and that <br />MSW would not be held at the site. There was agreement to limit the time to 24 hours. <br />Mr. Barrett also referenced Odor Suppression, noting that it would be required by the DEP.
