T <br /> 4 <br /> m ome witbin the meaning of the Housing Act of 1937, and qualifying for Iisting in the <br /> affordable housing ventory maintained by the Massachusetts Department of Housing <br /> and Cornnrnunity Development under G.L. c..40B,with such transfer to be made subject to } <br /> such terms as the Selectmen deem.appropriate,including a permanent deed restriction, <br /> which may contain a reverter clause,permanently restricting the sale or resale price,or <br /> rental cost,of any homes or apartments constructed on said parcels to no more than that <br /> considered affordable for persons of low income as defined by the U. S. Dept. of Housing <br /> and Urban Development and qualified for continued listing in the above affordable <br /> housing inventory..."; and <br /> WHEREAS, said Article 16 of said Special Town Meeting Warrant authorized <br /> the Board of Selectmen"...to make use of any other instrumentalities of the Town or <br /> other agencies and to enter into any agreements necessary to effect the transfer and <br /> restriction of such land in accordance with this Article, or take any other action relating - <br /> thereto."; and <br /> VFEEREAS,the Board of Selectmen published a Request For Proposals for the <br /> building of t two Units of single-family affordable housing, one Unit on each of the two <br /> above-referenced Parcels of land and the subsequent sale of the two Units to eligible <br /> purchasers;and - <br /> WFIEIEAS, Habitat submitted to the Town a Proposal dated January 7,2014,for <br /> ' the building and sale of said housing; aad <br /> AREAS,the Board of Selectmen during its meeting of February 10,2014, <br /> accepted the Proposal of Habitat and voted to enter into an Agreement with Habitat for <br /> the building and sale of said housing; and <br /> VMREAS,Habitat wishes to•purebase the Parrcels in order for Habitat to bu*ld <br /> one Unit ofsinle-family affordable housing on each of said Parcels and,upon the <br /> completion thereof, to convey each Parcel and its affordable Unit to an eligible purchaser;. <br /> and <br /> AREAS,pursuant to M.G.L. c. 40B §§20--23 (the"Act") and the final report <br /> of the Special Legislative Commission Relative to Low and)Moderate Income Housing <br /> Provisions issued in April 1983, regulations have been promulgated at 760 CZYM 56.00 et <br /> seq. (the"Regulations") which established the Local Initiative Program; and. <br /> REAS,the Conaonwealth of Massachusetts,acting by and through its <br /> Department of Housing and Community Development " M" ,pursuant to Chapter <br /> 23B of the General Laws, administers the Local Initiative Program LIP" on behalf of <br /> the Commonwealth'; and <br /> 2 - <br />
