MASHPEE ZONfNG BOARD OF APPEALS <br /> Petitioner: Habitat for Humanity of Cape Cod, Inc. <br /> Owner of record- Town of Mashpee <br /> 108 Orchard Road (Map 69 Parcel 1 8 <br /> 1ashpee, IIA 02649 + <br /> CP-2015-05 <br /> . Prior to the hearing, the Board received comments and correspondence from <br /> various Torn boards, commissions, committees and officials. <br /> 6. The Ptitioner is a Massachusetts non-profit corporation and an affiliate o <br /> Habitat for Humanity International. Accordingly, the jurisdictional <br /> requirements under 760 CMR 56.04(4) a) (e) have been satisfied. <br /> . The subsidizing agency is the Department of Housing & Community <br /> Development DHCD . Per a Determination of Project Eligibility Fetter(PEL) <br /> dated December 24, 2014, project eligibility under the Local Initiative Program <br /> (LIP) was granted. Accordingly, the jurisdictional requirements of 760 CMR <br /> 56.04(4) - have been satisfied. <br /> 8. The Town of M shpee awns the Property. Accordingly, the jurisdictional <br /> requirements of 760 CMR 56. 4a) (e) have been satisfied. <br /> 9. At Special Town Meeting on October 21, 2013, under Article 16, a majority o <br /> eligible voters,authorized that"...those Parcels shorn on the FY2 013 Mashpee <br /> Assessors' f laps as Map 69, Block 18 (108 Orchard Road) and Map p 69, Block <br /> (132 Quinaquisset Avenue) shall not be held by the Town as conservation <br /> land; and transferred to the Board of Selectmen to solicit proposals for the <br /> development of the parcels as affordable housing units. <br /> I <br /> 10. On January 7, 2014, Habitat for Humanity of Cape Cod, Inc. submitted its <br /> proposal to the Board of Selectmen for the development of the affordable <br /> housing units. <br /> 11. On February 10, 2014, the Board of Selectmen voted to accept the p'etitioner's <br /> proposal and entered into an agreement with the Petitioner. <br /> r <br /> 12. September, 2014 the Board of Selectmen and the Petitioner entered into a Land <br /> Disposition Agreement. <br /> 13. On December 24, 2014., DHCD sent a letter in approval of the Petition for <br /> project eligibility under the LIF program. <br /> 14. On January 15, 2015, the Petitioner Bled a Petition for a Comprehensive Permit <br /> with the Town Clerk. The Torn Clerk retained the Petition with. original <br /> signatures. The Petitioner delivered the remainder of the date-stamped copies <br /> to the ZBA office. <br /> 15. On January 20, 2015,the ZBA distributed copies of the complete Petition to the <br /> appropriate Torn Departments for review and comment. <br /> 2 <br />
