Richard Berri (Present) <br /> (continued) <br /> Chairman Crelg initiated lengthy discussion; he invited <br /> the Kerrigans to check the law regarding an untimely abatement <br /> filing. He informed major Taxpayer (Mashpee Commons ) who <br /> phoned and said the Company was advised the filing deadline was <br /> day in February and wanted to file for an abatement on all the <br /> properties . We clearly told him that he was advised of the wrong <br /> date . . . the Board of Assessors refused . . . we could not handle <br /> it . . . it was out of our jurisdiction! ! Mrs . Kerrigan asked if <br /> there is a higher board they could go to; Mr. Kerrigan asked <br /> about the Massachusetts State Board of Appeals. favid Bailey <br /> n n from the Mash <br /> informed they could apply for a abatement p <br /> Assessors .- it would have to be refused then you could <br /> appeal it to the Appellate Tax Board* He feels the ATB will say <br /> the same . . . "untimely filing" . . . but it is worth a try, Board <br /> Members expressed agreement. <br /> David Bailey explained that the guidelines for filing <br /> for an abatement are written on the tax bill ; the actual date of <br /> the filing deadline was written on this year ' s tax bill . Be <br /> informed the Kerrigans that our records show the bill was mailed <br /> to your address at Libra Lane, Mr. Bailey proudly stated: "We <br /> make every effort. to inform Taxpayers of their rights for f it ing <br /> for an abatement, we publish documents about filing for <br /> abatements , we make no attempt whatsoever to stop anyone from <br /> filing for an abatement, and we encourage people who think their <br /> assessments are wrong to file for abatements . l think we are <br /> probably the most open Assessing Department in the State as far <br /> as that is concerned! " . "It is not in the interest of <br /> anyone here, including myself , to have anyone ' s assessment <br /> other than correct Pand we work hard to make sure that <br /> they are oorret! � " vice Chairman Porten pointed out that Mr. <br /> Bailey felt he had resolved the problem . . . the o rerassessment <br /> of the Kerrigans ' property. David Bailey emphatically stated <br /> "Certainly , I thought I did! ! " <br /> Mr.- Kerrigan strongly stated "that is not the only <br /> reason we are here, thea, on 1.997 . l want to bring up our taxes <br /> for 1998 , which I feel are unfair ! ! " Mr. Bailey explained "It is <br /> the sane situation . 0 . you ' ve had until February to file for an <br /> abatement. " Marcia King initiated Lengthy discussion; she <br /> expressed feeling that pant of the problem is the Kerrigans Look <br /> at their taxes as being high but do not understand the abatement <br /> filing process . Chairman Greig emphatically stated that he would <br /> never allow his tax bilk to be mailed to a bank . . . it has no <br /> responsibility to look after your interest. Mr. Bailey explained <br />
