Discussion with DPW Director regarding Bylaws (continued) <br /> Catherine said on Page 27 there is a footnote referencing"Superintendent of Streets". <br /> This should be corrected. <br /> Also, "Superintendent of Streets" is referenced in other Articles and should be corrected <br /> to read "DPW Director"--namely: §147-1; §147-4; and §1.50-5.B. <br /> §147-2–Liability for Charges (Page 93). <br /> Catherine said to delete "$20"amount. Deb Dami said they can replace the dollar <br /> amount with more generic wording, such as"the fee schedule set by the Board of <br /> Selectman". <br /> 79-14–Dogs—Heritage Park(Page 58). <br /> Catherine said there is no enforcement or violation provision; or,possibly, does it fall <br /> under §79-5 --Violations and Penalties (Page 54). Deb Dami said first we have to start <br /> with §79-5 to see if Heritage Dog Park is covered under the Article. <br /> As an aside,Debbie said she is of the opinion that fees/fines dollar amounts should be <br /> taken out of the bylaws and treated as a regulation fee schedule to be enacted by the <br /> Board of Selectmen. Drew McManus commented that Conservation has a regulation <br /> schedule that references the bylaws and therefore only a public meeting is required to set <br /> or change fees. <br /> Debbie said insofar as enforcement,that's covered under §172-11 (Page 117). She said <br /> perhaps for the dog park it should be under the Animal Control Officer. Meg Santos <br /> commented that across the board the question of who is to enforce is a big issue. <br /> 15 0-3 –Bond_Requirement(Page 94). <br /> Catherine said the last sentence of that paragraph has a violation provision but no <br /> specification as to who is responsible for enforcing. In other words, who is issuing the <br /> fine? Drew commented that if a fine doesn't get paid, it goes to court. Debbie said then <br /> it could be simply that DPW Director or designee could issue the fine. <br /> 150-5 –Ttmporary TemporaryRepairs on Private Was (Page 95). <br /> Catherine pointed out that the last sentence of Paragraph A is missing a verb. Paul <br /> Robillard said"yes", it doesn't make sense. Deb Dami will correct this. <br /> Paragraph C... Catherine said who's approving the betterment? She said no funding <br /> source is indicated. Catherine said this provision is not usable since there is no funding <br /> source. Deb Dami said perhaps we should delete this paragraph and make Paragraph C a <br /> "reserved" status. <br /> 15.0-6 (Page 96). The title shown is not the correct title. It should read Conversion of <br /> Private Roads to Public roads. <br /> 2 <br />
