i <br /> 2 <br /> Co runny Preservation Comnuttee <br /> Minutes <br /> March l l 2008 <br /> APINTNIENTS AND HEARINGS: <br /> Public Heazing—Applications for October 2008 T'o vn Meet n <br /> Applications to be considered for funding at the October 2008 Town <br /> Fleeting are available in the Office of the Board of Selectmen and/or on <br /> the Town'swebsite: www.ci.rnashpee.ma.us. <br /> Being no comment,the Committee motioned to close the Public Hearing. <br /> Motion made by Ms. Buschenfeldt to close the Public Hearing. <br /> Motion seconded by Ms. Kane. <br /> VOTE: Unanimous. <br /> To date, one application has been received from the Mashpee Housing <br /> Authority relative to the Renes Assistance Program. <br /> COMMUNICATIONS AICD CORRESPONDENCE: <br /> Correspondence from Town Counsel: <br /> In response to the Committee's request for a legal opinion on several <br /> issues, correspondence was received from Ton Counsel Patrick Costello <br /> dated March 111,2008 with respect to this regard. <br /> With reference to the question of the limitations of Proposition 2 V, the <br /> 3 real estate surcharge is not included in the calculations of total taxes <br /> assessed for the purposes of 2 x . <br /> Regarding the sunset clause question, the Community Preser ation <br /> C nunittee may specify the period of time within which CPA funds are to <br /> be expended. It was agreed the CPC would specifically reference <br /> r appropriation reversion periods in future recommended votes as a <br /> condition of CPA expenditures. <br /> Information relative to the Prevailing Wage Lav was also discussed. It <br /> was noted that work performed on private property funded by CPA funds <br /> would not be subject to the compliance of the Prevailing Wage Law. For <br /> work performed on public projects, the Prevailing Wage Law i <br /> applicable. <br /> i <br />
