Conservation Commission
February 18 1993
Page 11.
Commission wishes to, they could give a reasonable amount of time, or extension, for
providing us with this other information and proceed from there. we would need all
those things I mentioned, In other words, I'll reiterate them for the record one
more .time, we would need. . . . . . .
Carmella Cardillo asked, Bob, what are the decisions that will be rade based on the
the results; what difference will it make?
Mr. Homeyer stated it would b.e whether or not they would be allowed to keep the
creosote ties or they would have to remove them and replace thea with other material
that would not be hazardous to the environment.
Ms Cardillo stated what she is saying is, if the test results do come back and there
is nothing wrong with them, you are not obligated to say we can keep them, you can
ill say to remove them.
Mr. Sherman stated, on the advice of legal counsel, we are not going to put ourselves
.in the position of saying 'that we will take any particular action based on the test
results, only that we will take thea under advisement. Where is a lot of controversy
over creosote. Once again, what we still need is documentation from the Cardillo
family for ghat was pre-existing,, pictures. we then would need to have Ned Philie
address some revegetation of the rest of it incorporated into a plan with Cape
Islands recommendations for stabilization of the slope, if the creosote is removed
or if the creosote stays. if it is decided by this Commission that the creosote
walls still have a tendency to leach and be destructive to the environ ent, and
this is a rare species area, and we ordered them removed, there would have to be
something substituted and we would need you to put an engineer's stamp on whatever
that is. Plan for the contingency that the galls might be removed.
Mr. Slavinsky stated, or rebuilt.
Ids Cardillo asked, all the walls do have to come out?
Mr. Sherman stated, no, I said he should bring us a plan based on that possibility.
Ms Cardillo asked, say the walls do have to come out, do we have to replace the walls
we take out
Mr. Sherman stated not in kind, -but they will have to do something with an engineer's
sump on it that will stabilize the slope; it's a very steep slope. without some kind
of engineering, that slope will not renin stable. I just wanted to clarify what we
i still need. He asked if there was anything else'?
Ms bann.ik stated she thought he stated it all very well
Mr. Sherman repeated, if accord can be reached on these issues, (pointing to the plan)
revege ation of this area and this area should be done as soon as possible because we
have the potential for erosion clown there and the haybales will have to be monitored
couple of times a week.
M . Cardillo stated he is trying to hire someone in the area for so much a week and
let them mai'main it.
Mr. Sherman stated that would probably be the wisest thing because they could call
i me. in other words let him know when there is a problem so we can fix it.
Ms Lannik questioned how soon this information could bep ro ided.
i - -
