-Conservation Commission <br /> April 9, 1992 <br /> Page 2. <br /> Anthony Petrusi, Clover Lane: Popponesset Beach Association owners all have <br /> beach rights to this property, we should have been given notice as well as the <br /> people within loo feet from her (Mrs. O'Neil) . It is not a spite thing, we just <br /> want to be allowed to use the beach. <br /> Ir. Sherman explained the bylaw only requires notice to those property owners <br /> within 100 feet of the property corners. Also, the bylaw does not address <br /> deeded access. <br /> Mr. Pet si: This fence goes across the aright of way. She is going 25 feet <br /> beyond her property line. <br /> Ids Lannik -stated what he was telling the Commission is not within the Commission's <br /> purview. if they have a problem, they would have to address it as a legal issue. <br /> Mr. Petrusi: She cleaned dune grass off the beach last year and the year before. <br /> i <br /> Mr. Sherman advised, if the Commission gives permission for any project, it is <br /> only for that which meets the standards of the Wetlands Protection Act. He had <br /> talked with lei chae 1 Gro t ke of New Se abury, who owns the proper ty, and they have <br /> no problem with it. <br /> Virginia Landry: As far as any future fencing, we have been given an assignment <br /> to keep the beach. We end up with a lot of rotten snow fences and people do not <br /> control where they end up. New Sabury should contact us; we will request that <br /> they let us know concerning putting up snow fences. She suggested it be removed <br /> during the suer. <br /> A letter dictated over the phone to the Conservation Secretary by Ferman Arms of <br /> 2 Kim Path was read into the record by the chai nan. lir. Arms is a member of <br /> the Board of Directors of the Popponesset Beach Association, He is objecting <br /> to the Fence proposed by Elizabeth O'Neill. It is 20 feet beyond her property <br /> lime. The Association has beach rights. The Popponesset Beach sign is a dis- <br /> cernible lime to determine the start of beach property and homeowner property. <br /> She should remove the fence she has put there, Mr, Ams stated* <br /> Mr. Sherman stated, when told to stop, he was not aware they went any further. <br /> CONTIN D TO JUNE , 1992 - 7:45 .m. <br /> Mr, Sherman stated if lairs. He presented plans, <br /> one for the vista pruning areas, the other for a proposed lighting plan. <br /> Mir. Sherman stated Ellis Allen's report has been received. He has given some <br /> recomendation for future vista ping. It may he appropriat6 to require <br /> some amount of mitigation. .As for the lighting plan, if it is- to be included <br /> in the filing, is it all in the paving? <br /> Mr, Zeppenfeld stated it crosses the paving and is then plowed underground. <br /> L - - - -- <br />
