Mrs. Sons asked if the construction of the wall would be by band and was told it will be. She asked haw they would stay off the marsh grass. Mr. Gray felt the Commission will have to condition there will be mitigation to any disturbed marsh grass. There are places devoid of vegetation, half is very conservative, siltation fence would serve as a limit of work to protect the sensitive areas. Mrs. Simons questioned whether they would have enough room to work ifa silt fence was 1pstalled. Mr. Gray stated there is two feet between the closest int to where the silt fence is shown and it is hand work. Mr. Sherman suggested he'meet with the landscaper before the work begins. Mr. Desrosiers suggested a silt fence up against a snow fence. This was agreed to by Mr. Gray. It is possible on an interim basis. Ms kik asked if this is out of the ACEC Mr, Sherman stated it would not make a difference to this particular project. . Gray advised the Conservancy Program has been notified. The wetland number is 58 and is under restriction. Mr. Sherman concurred with Mr. Gray about the wildlife Habitat* Mr. Gray advised the wall is -1 feet at the most; this is not a seawall and not subject to the normal ebb and flow of the tide. It will not require Chapter 91 licensing. Public comments were requested: DOROTHY STUDLEY: Lot 50, abutter. She asked how this is going to be ended off at her lot line and what access will be used to the site? Mr. Gray advised it is shown with a return and will disappear into the slope. Access will be between the two buildings to the Left of #44, looking at the water. The addition is on the north side. After discussion, the addition was withdrawn from the discussion. It will be the subject of a further filing. Landscaping plans will be provided, based on no additional structures. Mark DiBiase presented abutter notification. Mr. Sherman advised this is the result of a misunderstanding following the hurricane" work was done without a notice to the Commission. They were ordered to do a filing and no one appeared for the hearing. There is no apparent erosion or continuing problem. He suggested a negative determination with the understand- ing he will go back there this summer and look to make sure there is no erosion. This determination would have to be recorded. Mr. DiBiase agreed.
