Dave Sanicki did a plan. This exceeded the threshold <br /> under the bylaw. The Comnussion invoked the bylaw and Mario DeGregorio of <br /> Sabana did the report. There is a complication in that there are gree fresh <br /> piles of loan and the client was told to stop work. He was allowed to take <br /> one <br /> pile away to a neighbor's property that was out of the buffer zone. <br /> Mr, DiGregorio stated the objective was to assess and quantify the wetland lost by <br /> the removal. He measured the site that was altered; there was complete removal of <br /> shrub layer, 6000 s.f. .. the -sane as submitted on the site plan. He dreg a transect <br /> through the cut areas into the uncut areas. He tried to take a physical count of <br /> the stens to see what was out and the diameter of the trees cut to determine how <br /> it affects the wil(Rife in the area. <br /> There is a meeting of two habitats and is well within the definition of important <br /> for wildlift habitat. Dong term and short tern impacts were addressed. He read <br /> from the bylaw. Under state law, there is a precedent also; one in Harwich and <br /> one in Marshffld also. The Commission has jurisdiction under both the town and <br /> the state. Mr. DiGregorio read from the Harwich superseding order of Conditions. <br /> Mr. Sherman. asked if there was ample jurisdiction for using 10.2 1 and <br /> i Mr, DiGregorio stated there was. He rade his recommendations based on his field. <br /> work. It was left open-ended for the Commission to make their own recommendations. <br /> He read from his report. <br /> Mr. Homeyer questioned a report by DEP that Rosa Rugosa is excluding species of <br /> wildlife. Mr. DiGregorio stated it tends to be very invasive; it is an erosion <br /> control plant and is great as a hedge. <br /> Mir. Sherman stated opening p forest canopy lets in undesireable species. <br /> Mr. DiGregorio stated it allows annual plants to come in, like grass, more <br /> indicative of disturbed sites. To do work like this changes the plant coffffm2Ay. <br /> He suggested a mu' uimm. 50 foot naturally vegetated buffer between the lawn areas <br /> and salt marsh to screen human activity. A 30 foot wide strip has not been touched; <br /> wit 20 foot more upgradient. 'There is a lot of green briar and poison ivy. A 50 <br /> foot strip should be enough to restore wildlife habitat. To a question of how to <br /> get rid of the poison ivy, Mr. DiGregorio recommended a topical application of <br /> a wipe. The amount of fertilizers should be 1=`ted. <br /> He advised the area is within the Estimated Habitat zone and Appendix A should be <br /> filed. Forty five days should be allowed for thein review. <br /> . Sanicki stated this is not a problem. <br /> Mr. Sherman advised he did some research, over 40 species were observed. <br /> Mr. Sanicki stated Mr, DiGregorio did a very nice report and he has no dispute. <br /> Using his report and taking the original plan, he talked with Mr. agm3i_nas who <br /> insists removal was done only because of storm damage. <br /> Mr. Sanicki overlaid a 50 foot buffet' strip from the salt marsh; it will be left <br /> to revegetate on it's own. It is coming back as he speaks. From the 50 foot buffer, <br /> Mr. Jagmin s would like to sod or loam and seed. <br /> Mr. DiGregorio stated it would take a long time for the suckers to come back, that <br /> is why he is recommending supplementing with nursery stock. <br /> L <br />
