It is not incumbent upon them to do so.
Mr. McGrath stated it is a sandy bottom that got muddier as they went out., He told
then to sample under the float because he thought that was the area of most concern.
Mrs. Simons stated if there are shellfish outside of the existing float and they
want to make It larger, it is a concern to the Commission.
Mr. McGrath stated the samplings taken between the two pilings showed mud which is
not conducive to any shellfish.
Mrs. Simmons asked 'f his client would b willing pay for consultant f the
Commission's choosing to check this out.
Mr. Desrosiers advised he shellfishes the area and has found abundant shellfish
beyond the area of mud.
Mrs. S=ons asked if there were docks on the adjacent lots and was told one is vacant.
Mr. Desrosiers advised, since they are purchasing the boat, Raul Somerville felt this
is an advantage in getting the boat so it did not bottom out,
Mrs. S nons stated adjacent docks should be shown on the plan.
It was the consensus of the CoMnission that more information-is necessary.
Mr, Desrosiers would reserve calling in a consultant until after talking with Shellfish.
Public comments were requested; there were none.
Motion made and seconded to have a shellfish survey done by a consultant
chosen by the Conwdssion. This motion did not carry.
Mr. McGrath asked for permission to eonstrct the chain link fence.
Mr. Sherman stated it can be agreed to pernAt the chain- .ink fence; this can be done
in a letter. This is a safety issue.
Motion made and seconded to permit MLR Realty Trust to go ahead and construct
the 5-1/2 foot fence, as shown on the revised plan dated June 18, 1992.
letter to be sent granting permission.
Mr• McGrath asked, if they agree to eliminate the four foot extension, could they
forego the shellfish survey'?
Mr, Sherman suggested holding off on the motion made by Mrs. Simmons and talk t
the Shellfish warden. Mn McGrath can give soundings on the 8 x 20 structure,
provide another copy of the plan with soundi
