Conservation Commission November 1, 1990 Page 8. Ms Litts came forward on behalf of her mother, Mrs. Elizabeth O'Neil, who had received an enforcement order. She advised her husband is a P.E. and they surveyed the property; they found very little difference in elevations due to accretion on the beach. They had a problem with beach roses growing out into the grass. Snow fencing was put in to contain the sand. They decided to take them out and start over with grass, as it was originally. Revegetation plans were reviewed. Mr. Coffey asked since when the topo had not varied? Ms Litts advised it was last done in 1986; it varied 2/10 of. a foot. She stated she cannot determine where the end of the dune is; probably all of their property is in the dune area. Mr. Coffey stated his impression when viewing it just after vegetation was removed that a piece of the contour had gone with it, He was appalled that someone in that location was looking to have a suburban lawn. Ms Litts stated they did not see any other options; the roses were encroaching on the house. She did not- have any problem with beach grass as long as they have the fence there. She showed pictures. Mrs. O'Neil advised they had a problem with the cesspool this saner and some of the revegetation had to be taken away to correct that; that's ghat started every- thing. when they first bought the house, it had a ]awn like a putting green. They did not know they were digging in a sand dune and thought they were in their own yard. Mr. Sherman asked if cesspool work was done this summer and Mrs. O'Neil stated they excavated to pint in a pipe. He stated whoever did that work was in violation of the wetland Act also. He advised, since the incident, Mrs. O'Neil and Mrs. Litts have been cooperative. He feels the disturbed area is more than is shown on the plan. He suggested a. meeting at the site to ascertain precise dimensions. A Notice of Intent was not required because what was done exceeded the performance standards for dunes. He suggested the commissioners go out and view the site. The site must be stabilized for the winter, Mrs. O'Neil stated she has been told by several people in the field that it is not too late to plant and has someone on lime to do the work Monday if permission i received. Mr. Sherman stated he would want to speak with the person doing the work also. Ms Litts stated they want to replace the fence also. Mr. Sherman advised to put in a fence would require a Notice of Intent and a provision for maintenance could e made. It was .agreed Mr. Shennan would meet with Ms Litts at the site tomorrow at 10:00 a.m. He asked if the co=ssion was satisfied with the two species proposed or would like additional? Ms Litts stated she only warted the two. The commission agreed this should be left to the discretion of the agent.
