Conservation Commission
May 1 , 1990
Page 2.
HIGH WOOD WATER COMPANY, Daniel 's Island Road, continued from April 5.
No one appeared for this hearing.
Mr. Sherman advised the pipe was initially installed too low; this has been
rectified. Erosion control is adequate, Replanting needs to be addressed,..
He suggested an enforcement order requiring them to appear. The filing w s
done in January,
VOTE: MOTION MADE AND SECONDED To ISSUE AN ENFORCEMENT ORDER REQUIRING H I HWOO
WATER TO APPEAR BEFORE THE COMMISSION AND To COME IN WITH A NOTICE OF
INTENT ON JUNE 2 3 1990 AT 8:15. To be filed by dune 14),
Mr. Coffey advised the original proposal was for a separate crossing. The
proposed replacement is a free span bridge, The actual cons ru iori has n
impact,, a water line that runs with it has no impact, but a second separate
crossing is a different issue and unnecessary. It should be rade clear the
Commission is not in favor of a second separate -crossing,
Mr, Sherman advised this filing is only for temporary emergency work.
DOTE: Motion rade and seconded to deny the original without prejudice.
Unanimous vote
oo JAMES REIFFARTH,, for a Determination of Applicability on a proposal to
complete construction of an L-shaped addition 1 ' X 19' X f for an enclosed
porch addition and 81 X 10' deck supported on sono tubes at Monomoscoy Road,
Lot 38,
Dave San i ck i advised there is ars enforcement order against the property. The
construction was begun. The Board of Health issue has not been resolved; there
are legal questions involved. The Building Department issued a cease and Desist.
If the sanitary issue is resolved, they will return with a full Notice of Intent
for the sanitary system. They were before the Board of Health on two separate
issues and a-11 variances requested have been granted but they were over-ruled
by the state. They will grant to maintain whatever existed, After the denial ,
another sewage disposal system was prepared. The Board of Health did not want
to see a containment structure,
Mr. Sherman advised this only marginally comes within the jurisdiction of the
commission.
A letter from the building inspection to town counsel dated February 9 was read
into the record re stop work.
M
letter from Elias McQuaid dated March 2 was read also.
M . Sanicki stated both letters allude they were constructing for habitable
space, They are now simply going to rake this an enclosed porch, at this time.
A letter was read dated May 1 , from the building inspector to Kevin Kirrane to
stay the order to remove the addition and granting an extension to pursue all
options.
Mr. Robert Johnson, an abutter, spoke in, favor of granting the porch portion of
the project,
.
4
VOTE: Motion rade and seconded to find a negative determination.,
