Chairperson Studley <br /> replied that the - septic system would have to come before the Board of <br /> Health as the Commission cannot control installation of the septic system. <br /> She said that the Commission would want to know the location. <br /> Chairperson Studley asked , r. Scazzari to clarify his statement with refer- <br /> ence to the vegetation. Mir. Scazzari replied that it is not holding and <br /> that the sand is gashing down into the boatyard very consistently. He said <br /> that it is also running off the front of the property and corning down the <br /> hill and plugging up the storm drains,, <br /> Chairperson Studley said that everything would be taken under advisement, <br /> Mr. Cimeno invited the Commission to do an onsite inspection ..of the property <br /> Chairperson Studley replied that the Board would do an on-site inspection <br /> before i ssul ing an Order of Conditions. Nor. Scazzari asked that he be noti- <br /> fied of any decisions made by the Committee. <br /> Determination of Gerald S. Kaplan's Lot 30 Fells Pond <br /> Wayne Tavares stepped down from the Commission in order to represent Nor. <br /> Kaplan in a request for a determination to extend the bead area at his <br /> property located at 30 Fells Pond Road, Wayne told the Board that no <br /> work would be done near the grater .- it would be dome 16 feet from the <br /> grater. Mr. Kaplan plans to extend the area 20 feet back, Peter Durrmer <br /> asked Wayne what would keep the sand from washing downy Bayne replied <br /> that it would be a level above railroad ties and that it would be self- <br /> contained. <br /> Wayne explained to the Board that Mr. Kaplan had an.order of conditions <br /> to do the work originally which was issued back in August of 1982 and now <br /> he wants to know if he needs file again. <br /> Chairperson Studley said that the Commission would make a decision at their <br /> next meeting due to the fact that there were only two members who could <br /> vote on this determination that were present. <br /> Hearing of John Sullivan, Lot 34 Birch Way <br /> Mr. Robert Raymond was present to represent the applicant in an intent t <br /> construct a single family dwelling at lot 34 Birch way, <br /> Mr. Raymond explained that the construction of the single family residence <br /> was approved previously by the Commission under another filing; however, <br /> the time elapsed and they did not apply for an extension of the order in <br /> the proper amount of time. <br /> Mr. Raymond explained that the closest point of the work would be 63 feet <br /> of Mashpee Pond. He told the Board that the driveway which is located on <br /> the high portion of the lot required 'exterisive fiiiing along the lot line <br /> (which Nor. Sullivan has already completed) . He said that the plan and <br /> proposal from the original filing has not changed. He pointed out that <br /> they have taken precautions to provide hay bale dikes down on the slope <br /> to protect the water. He told the Commission that they plan to stabilize <br /> the slope with mulch and ground cover, <br />
