r <br /> ma.shpee Conservation Commission <br /> Minutes of March 28 , 1984 Page <br /> KLEIN HEARING <br /> The following hearing was held on the Notice of Intent filed by <br /> Dr. Daren Klein for lot 155 Whippoorwill Circle to construct a <br /> three-bedroom dwelling and related septic system within 100 ft. <br /> of wetlands. John S lavinky of Cape & Islands Surveying was <br /> present to represent the applicant. <br /> Nor. Slavinksy explained to the Commission that from the corner of <br /> the house it is roughly 90 feet across the road to an area that <br /> might be considered wetlands. The septic is back another 50 feet. <br /> Perk test was dome and ground water was tested, Jean Thomas asked <br /> f it was pottable drinking water? Mr. Sla.vinksy replied that it <br /> was, Jean Thomas asked for a copy of the water report for the <br /> records. <br /> Mr. Slavin6ky said that in his opinion he felt the vacant lot across <br /> the street is 'a wetland and that they needed to apply in order t <br /> do work within loo feet; such as, a gravel drive. <br /> Pauline DeLory asked if abutters were notified Mr. Slavinksy said <br /> that they were„ , <br /> It was noted that project number SE43-335 was issued by DSQE and that <br /> wetlands regulation 31CMR 10.02 and maybe 780 CMR 744.2 ba reviewed. <br /> Ernie Virgilio was present as an abutter 'and was asked if he had any- <br /> thing to say, He said that he was just there to listen. He was asked <br /> about the drinking water in the area. Nor. Virgillio said that he did <br /> not have any comment on that at the present time. <br /> Mr. Slavinsky said that Dr. Klein asked the same question about the <br /> water and the water laboratory analysis was done as a prerequisite to <br /> purchasing the lot, He said that he would get a copy of the report t <br /> the Commission. <br /> No further questions were asked, <br /> CFLANBERRY BCUG LICENSE <br /> In review of a memo dated March 27 from the Executive secretary asking <br /> that the Commission make recommendations relating to the cranberry bog <br /> license held by Donald Jermyn, the Board responded in the following <br /> manner. <br /> Two communications from Donald Jermyn and Robert Hallett dated March <br /> 8 entitled "Town-owned cranberry bogs” and dated March l entitled <br /> "Proposal for Sprinkler System Payback" were read into the minutes. <br /> Since Mr. Jermyn has not been able to find a bonding company, he is <br /> proposing a certificate of deposit ,in the sum of $2 , 500 to be held <br /> intly between the Town in lieu of the bond. <br /> 1r. Jermyn and Mr. Hallett stated that they have borrowed $80.000 for <br /> the installation of a sprinkler system at Garner and the Quashnet Bogs, <br /> They are attempting to gain a payback on the sprinkler system. Chair. <br /> person Studley said that she recalled that the sprinkler system was to <br /> e dome at their expense. <br />
