He asked if the <br /> debris which was dumped on the beach area removed or if it was still <br /> there? Chairperson Studley said that it was suitably burried and that <br /> it could not be proven that it was dumped there. Attorney 0;ilson asked <br /> Of it was all right now n other words , if they were not in violation <br /> of the cease and desist order. Chairperson Studley said that it is in <br /> existence and once we have a bad storm again, it will all wash out. <br /> ttornev Wilson said that the problem is that he thins the Commission <br /> is aware that there is debris in the banking itself -- there is cinder <br /> block. Chairperson Studley said that they are well aware of it. she <br /> said that she just read the letter from Mrs. Henning who observed debris <br /> taken down on the beach by the equipment. <br /> March Dardano pointed out that there is another ease and desist order <br /> in effect issued to the 'trustees for stuff on top of the bank which has <br /> not been complied with either. Chairperson Studley pointed out a pic- <br /> ture showing fill-dumped on the banking in violation of the 'trustees <br /> order of conditions. <br /> Chairperson Studley said that what--the ' o mis 'Ion, is ..con ern d with.--to- <br /> night <br /> ith.--t -nicht is the clamshell road and the violation of the original order of <br /> conditions which was issued. Attorney Wilson asked if the clamshell <br /> road was the main issue-.,' Chairperson Studley that it was the main issue <br /> and the fact that the area has not been- revegetated. Attorney Wilson <br /> said that he assured that the revegetation has to wait until they can <br /> grow g r#a s and forth n the banking. Chairperson Studley said that <br /> grass s growing beautifully all over town ' n all of the different con- <br /> struction <br /> . <br /> projects. She said that there has been no effort to do it and <br /> even after the order was issued them was no effort to put that in there. <br /> Attorney Wilson asked if she was speaking of the clamshell portion which <br /> is the access down through there chairperson Studley said the clamshell <br /> and ad 'oinin as shown on the plan in the "pink"area as none 'of it has <br /> 3 g <br /> been revegetated unless they are using automobile parts and tar. She <br /> said that there is not a blade of grass on there. <br /> Attorney Wilson said that his understanding is that where the clamshells <br /> are in the lower portion was the access area or the work area and that <br /> there has not been vegetation there* Chairperson Studley said that it <br /> was the access area, but that there was no permit for the road ' to begin <br /> with. She said that the clamshell road wa never in any of the plan f <br /> submitted to the Conservation Commission and that it is in violation. <br /> Attorney Wilson said that condition #17(c) in the order of Conditions <br /> which was issued on November 22 allowed for access via the Maushop village <br />
