To amend the order of Condi tions to include the removal of a portion of the inland bank, removal of two trees on the inland bank and improvement of the road leading to Lot 2043 Sakonnet Dr-i've. Mr. Sabatini presenting. foot high embankment slopes down to the driveway and he proposes to level it to an even incline up to the house. Mr. Sabatini advised the Fire Department has recommended the road be improved to allow passage of a truck. The road i badly rutted and i t is proposed to level the road and put crushed stone where water runs down the hi 11 creating a gu l 1 y on the pond side of the road. He is not proposing to widen the road. As requested by the Commission,, Mr. Sabatini agreed to obtain written permission from the next door neighbor for work on the portion of the road owned by then. Concern was expressed that the stone will wash into the pond. Mr. Sabatini agreed to create a berm with .sand and vegetation to prevent this. Ms Behrman stated the Commission will require written notice from the other owner of the road that he has no objection. Upon receipt of this the hearing will b considered closed and an amendment will be 'Issued within 21 days of that date'. The Chairman reported Stephen VanTol ' s resignation was accepted by the Selectmen, with regret. A memo from the Executive Secretary dated October 30 was read toting the request For Opinion of Counsel i denied because the Selectmen feel that i s is not the Conservation Commission ' s role to look at the effects on all town boards of the opinion of counsel dated October 3, 1986. This letter pointed out his opinion was equally applicable t other Conservation Commissioners . The Chairman stated that until such time as there may be a revision in policy, the opinion of Town Counsel sets the standard for defining Conflict of Interest and the procedures for behavior. Johns Pond Park Committee: Carol Jacobson advised Ernest Virgilio i s preparing the notice of intent for the beach sand . Edward Govoni , E -547: Mr. Govon i proposes to put in four catch basins and two tone trenches to control run-off. I t was noted that at the last hear i ng a top with elevations was requested . After discussion , it was agreed a letter will be sent to Mr. Gown i requesting that he obtain a statement from a certified engineer :-e the adequacy of drainage. Fox Run: At the Planning Board meeting last night, John Varkonda 's commentary was passed on by Ms Behrman. Commentary was also provid d by the Board of Health and an abutter .
