ashpee Conservation Commission <br /> Meeting of November 20, 1986 <br /> Page 4. <br /> George c. Logan - Continued: <br /> Ms Baylog stated the volume of fi l 1 is 67 cubic yards. There is a walkout <br /> basement. There will be no clearing beyond the deck and the driveway w.ill <br /> be of pervious material . <br /> HEAR I NG CLOSED - ORDER of COND IT IONS W I TH i N 21 DAYS. <br /> Ms Behrman advised there are problems on o kwa r Bair Road with a drain clogging <br /> up and an erosion gully forming . She referred to sloe Reardon's note on the <br /> drain going off Redwood Circle into Mashpee River wherein he stated i f the <br /> drain has been in existence for more than three years on the lot, the town <br /> cannot require the lot owner to do maintenance. The covenants will be re- <br /> leased with a lot of building around the mads with drains or culverts and <br /> resultant filling in will create problems. <br /> Mrs. Marsters suggested ars enforcement order be issued . <br /> Ms. Behrman further advised Mr . Sullivan has filed for a building on that <br /> particular lot. An added problem them is that a large part of the lot calls <br /> for 100 f 000 t zoning setback from the Mashpee River. I f Board of Appeals <br /> action i s required for docks before Conservation hearing , for consistency <br /> the Appeals Board action also should be required on zoning setbacks to <br /> protect a wetland . A checklist was suggested . A checklist for the Board <br /> of Health was suggested to see if all permits have been issued. <br /> The Commission was advised Sarakummit is coming in with their road. on the <br /> plan on file there is a drain and ditch going into the drainage area wetland <br /> which is not on the road plans filed with the planning board . <br /> VOTE: Motion made and seconded to accept the minutes of October 30 , 1986 as <br /> written, <br /> It was reported the CCCCC will be meeting in Brewster at the Natural History <br /> Museum on December 8. John Varkonda agreed to attend . <br /> John advised `:lie Conservation Law Foundation is requesting a donation. Mer t i ss appea red before the <br /> commission on September 1 1 , 1 with th a request for Determination of App l i c- <br /> ability to t i nq he proposed to remove a deck, put a foundation on the line <br /> of the deck and bu i 1 d i rig up. <br /> On Fr i day, November 1 , a f ter v i s i t i rig the s i to an enfo rcement order was <br /> issued by Ms Behrman as a small portion of the house had been moved to the <br /> side with the majority of the house carted away and a large cava t i on for <br /> the foundation was in place instead of the very careful digging around the <br /> base of the deck as stated a t the hearing . For the project proposed, a <br /> negative determination was issued , however , the project a€s it stands is <br /> not as described in the application . <br />
