Conservation Commission
meeting of February 5, 1987
Page 6.
Mr. Shaughnessy asked if the heavy vegetation in the area of the pier ; l 1 be
removed mechanically or by chemical means if the pier i to be used for swimming
Ms Langhauser stated this board has not approved the pier, but the difference
between a fire road with a T end and a pipe out into the water and a wooden
structure u sed for passive recreation cannot be compared. The gravel walkway
is 5 feet wide a . opposed to a road at least 12 feet wide. The gazebo will not
have l ights or outlets to plug in stereos or refrigerators. It is meant to be
a gathering spot. There are 52 units with a minimum of two people per unit .
If everyone decides t go swimming on a July weekend,, there w u l d not be enough
room on the gazebo or pier to allow them all there at once. The developer does
not intend any mechanical or chemical means to get rid of the vegetation. i f I
they did , they wm,' I d have to come back to the commission for- approval . To answer
his concerns , she suggested Mr. Shaughnessy request the Commission to write strict
conditions.
Mr. Shaughne sey stated if as she said, there will be no water and no electricity,
she has calmed his fears but he would l i e to see that in writing .
Mr. Tones, abutter, asked the meaning of passive recreation and what is the pur-
pose of the gazebo except for gathering and who f going to police what could
readily become a public nuisance. He suggested a lot of people will l aur n'.h their
boa
heir-
boa is at the public landing and go over to that dock if it is not policed . -i t Is
his belief a criterion is being set for an operation which will demand a great
deal of policing on the part of someone and who will take the responsibility for
protecting those who have made very large investments and built on the other- side
of that narrow piece of water.
Ms ehrman advised these are not proper matters for the commission as they have
no 'jurisdiction over these questions . She suggested Ms Langhauser answer then
outside after the hearing except for the question of passive recreation.
Ms Langhauser advised that meaning is those activities with very little e tran-
eous material such as swimming, boats without rotors , fishing , or sunbathing .
Mr. Rosenberg suggest Mr. Jones concerns should be addressed to the Planning
Board.
Carol McCue, resident of the lake for twelve years , stated a t that end of the
pond is not underground vegetation but above the water is lily pads , turtles
and animals that use that. Swimmers would get tangled up in the growth .
sailboat Cannot be used because the center bar cannot be put down .
Ms Langhauser stated she recognized their concerns but it must be remembered
they have 155 feet of shoreline and are requesting to put in one pier that is
12 foot wide and L-shaped. They are then directing over loo people on on.e spot
on their shorefront so that instead of disturbing the entire shorefront and pond
habitat, they are asking everyone in the area which is to the southern end of the
property to stay in one area. They deserve to have some access to the water.
CONTINUED PEND1NG PLANNING BOARD ACTION.
Ms Langhauser asked for an informal opinion of the Commission. Ms iehrman
stated the board could not be committed until aware of the changes , if any ,
the Planning Board makes.
