They have been before the <br /> Board of Appeals and have been granted a special permit.. <br /> John advised no comments were received 'from the shellfish officer but he d i d <br /> gale comments at the Board of Appeals hearing . T'h i s is in the area where an <br /> ear then bridge with a culvert was constructed creating problems with erosion. <br /> Dave Ryan agrees there is not commercially abundant shellfish population in <br /> the area . <br /> John questioned the provisions for continued maintenance on the 4 x 4 posts . <br /> Mr. Borgmann Mated at this point they have not received a request to do any- <br /> thing <br /> ny- <br /> thin but his recommendation to the client would be to install a small bubbler. � <br /> John stated h i s- concern is after a winter such as this , what would be neces sa ry <br /> to guarantee no ice upheaval , even with a bubbler, and the .appl i cant would be <br /> back for permission to drive -them back down or replace some. Mr. Burgmann stated <br /> the order of conditions could address this by requiring a penetration of 1- <br /> 2o feet on the piles . <br /> It was noted the depth at the end of the dock is 2. , mean high water. Ms. <br /> B h rman expressed concern with the float sitting on the bottom and boats going <br /> in and out. Mr. Burgmann stated an alternative would be to put it further out s. <br /> into the bay. A longer dock would provide a more usable faci 1 i ty for the client. <br /> John stated there is a very substantial fringe marsh and the dock further out <br /> would lessen the likelihood of propash. <br /> Mrs . Jacobson stated a dock 110 feet long to get out to. one foot of water i <br /> net practical . <br /> John questioned whether the c l lent wou1d be amenable to construct a raised <br /> walkway rather than steps in order to maintain the root structure on the bank. <br /> Mr. Burgmann stated teris would make it more precipitous to get down to the level <br /> of the dock and did not feel his client would be adverse to the suggestion , but <br /> from en aesthetic point of view the steps would lessen the impact. He stated <br /> he did not envision clearing on the side of the steps . <br /> Ms Behrr an requested a vegetation plan ' be submitted with shrubs rather than <br /> low planting . Dr . Allen stated he would prefer to Deep it in its <br /> present location.
