Request <br /> for Determination of Applicability for construction of Wintergreen Road and assoc- <br /> iated <br /> s c- <br /> iated drainage falls within Seabrook Pines 'subdi tsion. Approval on the 25 lot <br /> cluster subdivision was received on January 7, 1987. The site contains 9. 1 acres <br /> of open space, 8.7 of which will be deeded over to the Town of Mashpee to serge <br /> as a link for the trail system. The wetland is located on lots 13 and 14 and i s <br /> oo square feet. It does not contain six inches of water at any one time during <br /> a year and does not have l acne land area . It is a depression with no inlet <br /> or outlet. It does serve to hold flood water which eventually seeps back to <br /> ground water. There is no plan to fi l 1 this area . There is sufficient area <br /> n the lot to put a home and septic and well without disturbing the wetland. <br /> Ms Behrman questioned whether any deed assurances were planned to ensure that <br /> the depression would not be filled durIng construction . <br /> Mr. O 'Connell stated when the lot is sold, If any development is planned close <br /> to the wetland they would have to cane before the commission. He further ad- <br /> v i sed the drainage easement goes around the wetland and protects i t. There <br /> are homeowners associations established with covenants that would incorporate <br /> a maintenance schedule for -the cleaning out of the catch basins on a regular <br /> basis. <br /> M r. Bu rgr�ann stated his firm designed the drainage system which is configured <br /> in this manner as -John had reviewed the original plans and suggested this <br /> method might lessen any erosion impact. <br /> HEARING CLOSED - NEGATIVE DETERM INATION. <br />
