Abutters notices presented . <br /> This proposal was before the commission last surer and denied so that the app- <br /> licant <br /> pp- <br /> 1icant could return- with a proposal to fix up the bark and do something about <br /> a drain. That treatment has been incorporated with this Notice of Intent. Tine <br /> plan which is different than the one submitted with the .Notice of Intent was <br /> presented. As a result of being continued, a' new ne ig"hbor, Michael Gutman, <br /> called Mr. Clark statin he wished to do a dock at some time and asked if Dr . <br /> Rousseau would consider sharing a dock. This week, Dr. Rousseau agreed, al - <br /> though <br /> l -though reluctantly, so the dock will he shared . The difference now is that <br /> the dock i s on the property line. This was before the Board of Appeals i n <br /> June and he presented a copy of their decision. A copy of the new plan will <br /> be submitted to the Board of Appeals. <br /> It is proposed to use the same catch basin as shown, block off the existing <br /> } pipe and put On a 6 x 6 pit with '. of stone around i t. Rosa Rugosa will be <br /> planted all the way over to the house. The dock will only be appropriate for <br /> small boats. <br /> Mr. Clark was congratulated for arranging the sharing of the dock. There were <br /> no comments from abutters or commissioners . <br /> HEARING CLOSED - ORDER OF CONDITIONS WITHIN 21 DAYS . <br /> (The revised plan was dated today. Mr . Clark included a written statement <br /> that this modifies the notice of intent . ) <br /> 8: 30 - Jonathan Burt i s , 12 Riverside d . , Request for Determination of Appi i c- <br /> abi l i ty to renew windows , s idewal l , roof, replace and renew original framing , <br /> r <br /> decks , bulkhead and stairway. Mr . Burt i s presenting . A letter from the prev- <br /> ious <br /> rev-Ious owners stating what YY l read built as presented . <br /> John advised this was brought to the Commission ' s attention by way of a phone <br /> call . He, with the assistant Building Inspector, visited the site and as Mr. <br /> Burt i s was working within the resource area an enforcement order was issued <br /> and a stop work order by the' Building Inspector. I t was decided a request <br /> should be filed to determine ine the- need of a Notice of Intent. He asked Mr. <br /> Burt i s to describe the work. <br /> It includes the decks, bulkhead, retaining walls, rails , stairway, upper deck, <br /> shingling and interior ori . Everything that has been there since the house <br /> was built F n 1951 is being replaced . There are logs in the water he will have <br /> to pull out. There was a retaining wa 1 l on each side of the beach and around <br /> the entire perimeter of the property. His homeowners policy was cancelled due <br /> to this being in a state of disrepair and this began the process . A letter to <br /> this effect was provided. All work will be done by hand . <br /> -Ms Behrman stated any work done with i n the resource are would require a Deter- <br /> mination <br /> eter-- <br /> mination of ApDlicability and for every repair the Conservation Officer should <br /> be contacted . <br /> HEARING CLOSED - NIL AT I v E DETERMINATION. <br /> VOTE: Motion made and seconded to issue a Negative Determination <br /> tO Jonathan <br /> Surds. <br />
