Board of Health permits have been issued and ,`:he well has passed 1 T. Ms duPorrt stated she saw no problem following along with the D .E.Q.E. conditions as they are very stringent. Mr. Williams stated he has been assured by the contractors the project can go forward with no probl-em and they can comply with the conditions. Ms . Behrman stated any clearing , alterations , or landscaping on the bank area would have to cone before the commission. VOTE: Motion made and seconded to modify the Town Order of Conditions to Jim Williamson to coincide with D .E. .E. Superceding Order. Jake Kaplan, Monomosco : John advised this was denied because of not being staked, i t is S'taked now. The su pe rced i rig Order from O .E. .E. pulled the house back. It was agreed to amend the town Order of Conditions to coincide i-th D .E.Q.E. Discussion of the Minutes of January 29 , 1987 and February 5, 1987: 215/87+ Berkowitz: Ms du Pont stated they d l d exceed 509 of the original building and therefore the act of 19"8 applies to E. L. Shore and also to Mr . Berkowitz. She stated she wished to have it recorded in the minutes that there is an outstanding order of conditions and is requ t i n that something be done concerning this. Vote: Motion made and seconded to accept theminutes of February , 1987, s amended. Mote: Motion rade and seconded to accept the minutes of January 29, 1987 as presented. Ms. Behrman advised ars appointment with F i nOom is being arranged as they have severly cut back the Board Secretary Services. With the rate in increase in board hearings, this is not Justified . Bob Burgman appeared before the Commission to state a letter was sent to the Commission re Mr. Bol ger 's emergency Order of Conditions to advise he has had a problem getting anyone to do the work. A condition states no mechanical equipment to be used and he is asking that condition be modified to allow for mechanized equipment to be used at the foot of the wall (Condition 10) . He i s looking to use a crane and a rubber tired from t end loader. It was agreed this was a reasonable request. Emergency VOTE: Motion made and seconded to modify Special Condition 10 on the/order of Conditions to lei l l lam Bolger (43-589) to allow the use of mechanized equipment as stated i n his letter of 2/18/87 ori the beach area only a part of his project to do emergency repairs . i i -his duPont left the meeting at 10:25 p.m. The Chairman noted it was necessary to discuss the Orders of Conditions without a voting quorum. Orders for Palmer, Tu ro, E l oar i t , Bolger to be held for a vote.
