Mr. Williamson stated <br /> he has a purchase sales agreement. Board of Health permits have been issued and <br /> ,`:he well has passed 1 T. <br /> Ms duPorrt stated she saw no problem following along with the D .E.Q.E. conditions <br /> as they are very stringent. <br /> Mr. Williams stated he has been assured by the contractors the project can go <br /> forward with no probl-em and they can comply with the conditions. <br /> Ms . Behrman stated any clearing , alterations , or landscaping on the bank area <br /> would have to cone before the commission. <br /> VOTE: Motion made and seconded to modify the Town Order of Conditions to <br /> Jim Williamson to coincide with D .E. .E. Superceding Order. <br /> Jake Kaplan, Monomosco : John advised this was denied because of not being <br /> staked, i t is S'taked now. The su pe rced i rig Order from O .E. .E. pulled the house <br /> back. It was agreed to amend the town Order of Conditions to coincide i-th D .E.Q.E. <br /> Discussion of the Minutes of January 29 , 1987 and February 5, 1987: <br /> 215/87+ <br /> Berkowitz: Ms du Pont stated they d l d exceed 509 of the original building and <br /> therefore the act of 19"8 applies to E. L. Shore and also to Mr . Berkowitz. She <br /> stated she wished to have it recorded in the minutes that there is an outstanding <br /> order of conditions and is requ t i n that something be done concerning this. <br /> Vote: Motion made and seconded to accept theminutes of February , 1987, <br /> s amended. <br /> Mote: Motion rade and seconded to accept the minutes of January 29, 1987 <br /> as presented. <br /> Ms. Behrman advised ars appointment with F i nOom is being arranged as they have <br /> severly cut back the Board Secretary Services. With the rate in increase in <br /> board hearings, this is not Justified . <br /> Bob Burgman appeared before the Commission to state a letter was sent to the <br /> Commission re Mr. Bol ger 's emergency Order of Conditions to advise he has had <br /> a problem getting anyone to do the work. A condition states no mechanical <br /> equipment to be used and he is asking that condition be modified to allow <br /> for mechanized equipment to be used at the foot of the wall (Condition 10) . <br /> He i s looking to use a crane and a rubber tired from t end loader. <br /> It was agreed this was a reasonable request. <br /> Emergency <br /> VOTE: Motion made and seconded to modify Special Condition 10 on the/order <br /> of Conditions to lei l l lam Bolger (43-589) to allow the use of mechanized <br /> equipment as stated i n his letter of 2/18/87 ori the beach area only a <br /> part of his project to do emergency repairs . <br /> i <br /> i <br /> -his duPont left the meeting at 10:25 p.m. <br /> The Chairman noted it was necessary to discuss the Orders of Conditions without <br /> a voting quorum. Orders for Palmer, Tu ro, E l oar i t , Bolger to be held for a vote. <br />
