M r. Clark stated <br /> this was in 1980, E 437144. He advised this order requ i red natural vegetation on <br /> the conservat,ion easement to be allowed to re-establish itself and light vegetation <br /> to be added. This would constitute .violations . The prior owner was Mr. Alessandro. <br /> John advised no Certificate of Compliance has been issued. 43-144 is only for the <br /> dock, not the house. <br /> Mrs . Marsters asked if the septic complies with the Ma tepee By-law. <br /> Mr. Rosenberg stated if no- Cer t i f i tate of Compliance has been issued on the old <br /> Order of Conditions , the Commission cannot entertain any new application. <br /> Mr. Clark stoted to correct they would be looking to come back with landscaping <br /> plans including the path and steps. <br /> Mr. Rosenberg stated it must be determined if the house o pl i es with an order of <br /> Conditions and what, if anything , must be done to bring the house and dock into <br /> compliance. <br /> Ms Beh rman expressed Concern with a five bedroom and potentially ten per pl e that <br /> the patio area being removed is' to be replaced with a 12 x 12 deck. Continued from February 5, 1987. <br /> The Planning Board has approved the revised plans which were distributed to the <br /> Commissioners . The Gazebo has been removed from the lot. The walkway extends <br /> through the area of the Gazebo for 97 feet. Additionally, the Planning Board <br /> added Railroad tiles to the gravel walkway because of the steepness of the bank. <br /> The slope will be broken every six inches with a tie. The wa 1 kway i s i n the same <br /> location. Pier length and width is the same in the same location . With remova l <br /> of the gazebo there will be no additional Clearing of vegetation on the bank. <br /> The wooden walkway will be done by hand and the walkway across the wetland i <br /> proposed to go through an existing cleared area. <br /> Ms Behrman Mated without the gazebo the pier should be downsized. Ms Langhauser <br /> stated without the gazebo it is more important to be 12 ' gide as more people wi l l <br /> have to sit on the pier. She further stated s t is not meant to be a mooring facility <br /> and there is no proposal to remove any vegetation on the bank other than to put in <br /> the pier. Future use of the shorefront for the 52 unit Condo subdivision can be <br /> restricted in the Order of Coad. <br />
