Conservation commisison <br /> Meeting of May 5, 1988 <br /> -Page 4. <br /> Mrs. Regan stated they will not touch the road. <br /> Mr. Rosenberg stated the 70 foot line is across the back of the house and asked <br /> what height they are filling to; if 76 feet, there will be a drop of 6 feet to <br /> the house. <br /> Mr. Gomes stated this is temporary until they decide whether to build the house. <br /> Mr. Rosenberg stated the Notice of Intent cannot be amended. According to the <br /> plan one-half of what is to be filled is on the road. <br /> Mrs. Marsters stated they should show the Commisison a side view with the road; <br /> show the existing grade and show what is planned. <br /> Mrs. Ferriday stated there is a large Beech tree that must be welled for protection. <br /> Comments from the public <br /> Jim Walsh, Lots 101 and lot: He asked if Mr. Gomes was a landscape architect and <br /> if the plans were prepared by an engineer. <br /> Mr. Gomes advised he is not and the plans were from a previous owner. <br /> Mr. Walsh viewed the plan. He stated the contention with the first two projects <br /> the Regans put into effect became the paper road. Their engineer took the measure- <br /> ments <br /> ure- <br /> vents off of the blacktop. Not only are the center lines not on center, but they <br /> are 13 feet off on the other side. He stated he would like to see the engineer' s <br /> plans for the new lot, the gradients and the landscape architect. Also, the re- <br /> vegetation plan for what they have already stripped. <br /> Ms Dehrman stated the topo will be used for; whatever happens on the lot and re- <br /> quested they indicate exactly, on the copy of the topo map, where they are asking <br /> to do this. Also, the Board would life a profile. The sketch plan, as a legal <br /> document, would not be in compliance with state regulations. <br /> Mrs. Ferriday stated there is 'no way 48 cubic yards of fill can be used there. <br /> Evelyn Bushenfeldt, President of Tirberla,ne Shores Association, spoke for the <br /> abutters in the area and Association members. Two houses down the street from <br /> Mr. Regan have both complied with gravel driveways and other rules on thein <br /> plans and are upset, as well as other people on the street who feel that the <br /> trees were cut down on the side of the pond and both houses have paved driveways <br /> which were not on the plans and have not been removed. The Town 1s spending <br /> money on upcoming litigation because Mr. Regan has not complied with any of the <br /> rules. <br /> Mrs. Ferriday suggested to Mr. Gomes, if fill is to be used, netting and planting <br /> should be considered. <br /> Ms Behrman advised Mrs. Regan that copies of the request for modification of the <br /> Order of Conditions and plans should be sent to DEE.
