Conservation Commission
June 1 , 1989
Page 10 .
Mr , Rosenberg stated that is a float and a boat . Mr . Franhi pointed ,
there ' s the float r1gt there , that ' s a boat . Mr , Rosenberg agreed ,,
but there is a float ori the end and the boat is tied to the float
and here ' s another photo right here that shows and L-shape , neither
one taken by the applicant but by government agencies .
1r . Rosenberg stated the Commission is interested 1n solving the
problem. He asked if Mr , Fran hi would be happy if they wont back
to an L-shaped float and Mr , Fran hi stated no . Ir . Rosenberg asked
if they take it out and put it back this way and her . Franhi again
stated no .
Atty .. Fox asked i f there is anything he could do to make Mr . Fran h i
appy
Mr . Fra nch i stated they can take the float out of the water , the
existing float right out .
. Rosenberg suggested they amend the Notice of Intent and leave the
dock this way , or make it L-shaped , and a decision will be rendered
on it . If they warm to stand on either this or the other -way and
ask the Commission if they ' ll grandfather i t , in either configuration ,
they will be given an answer on that score . This s pec i f ic confi gu a i n
is not grandfathered , if left in a position of having to - make a pre-
liminary determination of grandfathering , it would be difficult .
Mr. San ick i stated , when first submitted , be did not have this other
information . He indicated they will revise the plan to relocate the
float , rremove the pile , i n accordance with the evidence shown this
evening .
Mr . Rosenberg advised if they revise the plan that way , a determin- tin
will be made with respect to grandfathering what ' s on that plan ,, not on
this plan ; that ' s where the problem crimes .
Atty . Fox stated , as he understands it , the Commission Can ' t grand-
father this because it wasn ' t there before . Mr . Rosenberg agreed .
Atty . Fox Continued , so ,you ' re saying we ' huld redo the plan .
Mr. Rosenberg stated if they want the Commission to grandfather a
dock , they will have to give the Commission the L-shaped dock ,, this
one cannot be grandfathered .
Atty .. Fox stated they would have to revise the plan and resubmit the
plan as revised . Mr . Rosenberg stated that was right .
Mr , San i Ck i stated they should relocate the float i n the configuration
shown and ask the Commission to grandfather it .
. Rosenberg stated once it is grandfathered, we can reach this problem
here . We w i 11 c I ose the hear i rig upon rete i pt of a rev i sed p 1 ars and we
will rake our decision based on the revised p1art , you will not need
another public hearing . Your outer option is to come in and ask us
to permit this .
Atty . Fox stated the Commission is being very fair .
. Rosenberg stated if they ask the Commission do this ,, it would
have to go through the whole routine and they would have to go back
